초록

This paper analyzes the intensifying conflict between national security concerns and the rules of the World Trade Organization (WTO). In particular, it focuses on how Article XXI of the General Agreement on Tariffs and Trade (GATT), which codifies the “national security exception”, allows countries to justify unilateral actions that may potentially undermine the international trade order. Employing a comparative case study approach, this study examines recent security-driven economic measures and highlights the complex challenge of balancing the principles of free trade with member states’ rights to invoke national security exceptions. Achieving this balance requires transparent justification when invoking such exceptions, the establishment of WTO-level monitoring and oversight mechanisms, the strengthening of the dispute settlement system, and the promotion of dialogue and cooperation among member states. This paper suggests that the future of the WTO depends on how cooperatively its members respond to these challenges. By establishing clear standards, enhancing transparency, advancing institutional reform, and fostering international cooperation, the WTO can reconcile national security interests with the principles of free trade and contribute to the construction of a stable and prosperous global trading system.
