횡단교차적 사회문제의 증대는 민관부문 간 협력뿐 아니라 정부부처 간 조정 및 협업에 대한 새로운 행정수요로 인식된다. 본 연구에서는 ‘정책문제의 횡단교차적 속성으로 인해 다수의 규제부처에 영향을 주거나 부처간 조정 및 협업을 통한 문제해결이 필요한 경우’를 “다(多)부처규제”로 정의하고, 그 범위를 Freeman and Rossi(2012)가 제시한 공유규제공간(shared regulatory space)의 네 가지 유형을 포괄하는 것으로 상정하였다. 다부처규제는 가외성, 비효율성, 규제공백 등의 문제를 발생시키므로 규제정책의 효과성과 규제개혁의 체감도를 높이기 위해 다부처규제를 체계적으로 관리할 필요가 있다. 이를 위해 우리나라의 주요 규제개혁제도를 검토하고, 부처간 조정과 협력을 통해 다부처규제 문제에 체계적으로 대응할 수 있는 개선방안을 제시하였다. 검토결과 우리나라의 현행 규제개혁제도는 OECD의 권고를 충실히 이행하여 국제적으로 우수한 평가를 받는 반면 부처간 조정과 협업에 대한 관리방안은 전반적으로 매우 미흡한 것으로 나타났다. 이를 보완하기 위해 정부업무평가에 다부처규제 협업요소를 포함하고, 규제등록시 연관규제를 타 부처 소관규제까지 확대하여 명시하며, 규제정비종합계획을 통해 중점관리가 필요한 다부처규제를 선정하여 관리하고, 규제영향분석서의 작성단위를 재조정하여 다부처규제의 영향을 종합적으로 고려하도록 관리하는 방안을 제시하고자 한다.
Abstract
The increase of cross-cutting social problems is recognized as a new administrative demand for interagency collaboration as well as intersectoral cooperation. This study defines "multi-agency regulation" as 'the case affecting a large number of regulatory ministries due to the cross-cutting nature of policy problems or regulatory problem that needs to be resolved through interagency coordination or collaboration.' Our definition of multi-agency regulation covers four types of "shared regulatory space" proposed by Freeman and Rossi (2012). Multi-agency regulations create problems such as inefficiency, redundancy, gaps, etc. It is necessary to systematically manage multi-agency regulations and increase the effectiveness of regulatory policy and the sense of regulatory reform. We reviewed Korea's major regulatory reform systems from the aspect of multi-agency collaboration. The results show that the current existing regulatory reform systems in Korea have weakly been responsive to the issue of interagency coordination. This paper proposes to include multilateral agencies' cooperative elements in the government affairs evaluation; to specify the information on other departments' related regulations in the regulatory registration card; to select and manage significant multi-agency regulations through the comprehensive regulatory improvement plan; to consider the impact of multi-agency regulations by re-adjusting the unit of analysis of Regulatory Impact Analysis.
