미국, 영국, 한국의 규제개혁 관리체계 특성에 관한 연구 : 최대유사체계 분석기법(MSSD)을 중심으로

4차 산업혁명 시대는 신기술의 출현과 더불어 정부와 민간 간의 연결이 융복합적으로 이루어질 것으로 전망한다. 신산업의 성장을 저해하는 기존 규제는 미래 사회변화를 저해하는 장벽이 될 수 있기에 규제개선을 실행하기 위해서는 이에 따른 전략 마련이 필요한 시점이다. 본 연구는 미국·영국·한국의 규제개혁 특성 사례를 비교분석하고 분석결과를 토대로 우리나라에서 나타나는 규제개혁의 문제점이 무엇인지 살펴보고자 하였다. 본 연구에서 사용한 측정도구는 OECD에서 제시하고 있는 규제관리시스템의 제도적측면 4가지 항목과 수단적측면 2가지 항목을 독립변수로 설정하고 최대유사체계 분석기법(MSSD)을 활용하여 비교분석하였다. 분석결과, 미국과 영국의 규제추진기구는 중앙부처형으로 일찍부터 규제개혁을 실시하여 현재 규제관리단계로 진입한 상태로 나타났다. 우리나라는 규제개혁이 제도화되어 있음에도 불구하고, 이원화된 추진체계로 인하여 규제효과는 미비하게 나타났다. 각 나라별 규제개혁 비교분석을 토대로 우리나라의 규제개혁 개선방안을 제시하면 먼저, 현재 이원화된 규제개혁기구를 다층적 거버넌스체계로 개선하는 것이다. 다음은 규제전문인력이 턱없이 부족한 만큼 공무원이나 민간전문가를 중앙정부 차원에서 교육 및 훈련하여 규제 현장에 수급하는 방법이 강구되어야 할 것이다.
Abstract
In the future, the regulatory reforms are expected to become an essential national task in order to strengthen national competitiveness in accordance with the rapid social change in the era of the 4th industrial revolution. Recognizing the importance of such regulatory reform, Korea has been making aggressive efforts to establish and strengthen social regulations in each regime. Nevertheless, there is no positive evaluation of the regulatory expert group, corporations, private sector, and civil servants regarding the performance standards of regulatory reform. The purpose of this study is to examine the problems of regulatory reforms in Korea based on the comparative analysis of regulatory reform cases in USA, UK and Korea. The measurement tools used in this study were comparative analysis using the Maximum Likelihood Analysis System (MSSD) by setting the four institutional aspects and the instrumental aspects of the regulatory management system proposed by OECD as variables. As a result of the analysis, regulatory agencies in the United States and the United Kingdom have been regulatory reforms since the execution of the central government, and have entered the current regulatory management stage. Although regulatory reform is institutionalized in Korea, regulatory effects have been insufficient due to the dualized system. Therefore, an operational plan should be developed to improve the dualized regulatory reform mechanism into a multilayered governance system.
