저작권자는 다른 사람이 저작물을 이용하려고 할 때 비용을 받을 수 있다. 그런데 최근 다양한 미디어 환경에서는 저작권자가 자신의 저작물이 이용된 사실 자체를 알기 어렵다. 이러한 점은 저작권자가 정당한 권리를 행사하는데 어려움으로 작용한다. 또한 거시적으로는 저작권 시장이 창작과 정당한 가치 확보 사이의선순환을 이루고 산업적 발전으로 나아가는데 장애가 된다. 특히 방송 분야에서 이러한 문제는 심각하게 나타난다. 따라서 방송에서 나타나는 표현물에서 다른 사람의 저작물을 이용한 경우를 특정하고 이에 대한 비용을 정산할 수 있도록 하는 모니터링 체계가 논의되고 있다. 다만 이러한 논의 가운데 다른 사람의 저작물을 이용하여 저작권법상의 책임을 갖게 되는 경우를 특정하도록 할 의사결정 체계는 아직 논의가 없는 상황이다. 이에 본 연구에서는 이를 위한 의사결정 체계를 큰 틀에서 모색해보았다. 이 체계는 정량적 유사도 산출 단계, 보정 및 심층 분류 단계, 그리고 최종 결정 단계로 제시하였으며, 각 단계에 관하여 고려되어야 할사항을 검토하였다.
Abstract
Copyrights can receive costs when other people try to use copyright. However, in various media environments, it is difficult to know the fact itself was used. This is a legitimate right rights, but the copyright holder acts as difficult. In addition, macro, the copyright market is a virtuous cycle between creative and securing legitimate values between creativity and right value. In particular, these problems appear seriously. Therefore, the monitoring system using other person works in the broadcast, and monitoring system is discussing system and settlement system. However, the decision system to specifically, the decision system to specifically specify where the copyright law is responsible for the copyright law. Therefore, in this study, it was found in a big framework for this study. This system presented in quantitative similarity, correction, correction, correction and the final decision stage, and the final decision was considered to each stage.
