본 연구에서는 방송에서 사용하는 문학예술저작물의 수익배분 개선을 위해 국내 방송시장 규모, 글로벌 저작권 사용료에 대한 내용을 살펴보고 국내외 저작물의 보호 규정을 확인하였다. 또한 국내 문학예술저작권단체의 방송사용료 징수규정 등을 검토하였으며, 해외 문학예술저작권단체의 방송사용 저작물 징수규정 등을검토하였다. 국내에서 방송된 TV와 라디오 21개 방송채널 34개 프로그램을 대상으로 모니터링을 실시하였으며, 조사결과 문학예술 분야의 저작물이 사용된 것을 확인하였고, 확인이 불가한 저작물도 일부 발견되었다. 방송에서 사용하는 저작물의 수익배분 개선을 위해서는 저작물 확인 기술개발과 공정한 저작물 수익배분 생태계 구축이 필요하다.
Abstract
In this study, to improve the profit distribution of literary and artistic works used in broadcasting, we examined the size of the domestic broadcasting market and global copyright fees, and confirmed the protection regulations of domestic and foreign works .Regulations on the collection of broadcasting fees by domestic literary and artistic copyright organizations were reviewed, and regulations on the collection of works for broadcasting companies by overseas literary and artistic copyright organizations were reviewed. In this study, to improve the profit distribution of literary and artistic works used in broadcasting, we examined the size of the domestic broadcasting market and global copyright fees, and confirmed the protection regulations of domestic and foreign works.
