Abstract

This study test the deterrent effect of formal punishment in cyber stalking. Previous studies found that several explanatory factors from theories of differential association, social control and general theory are more important in explaining crime rather than legal punishment and emphasize that those factors have interaction effects with punishment. This study examines individual difference in legal punishment and tests interaction effects between legal punishment and differential association with cyber stalkers, morality, and self-control. However, there are contrasting views in individual differences of deterrent effects whether its effect is high in high differential association with cyber stalkers, low morality, and low self-control or low differential association with cyber stalkers, high morality, and high self-control. Analyzing 270 university students in Seoul, results show that the perceived threats of punishment deters cyber stalking and its intention. However, it is shown that its deterrent effect is small when other variables such as differential association with cyber stalkers, morality, and self-control are controlled. It is found that differential association with cyber stalkers and morality have significant effects on cyber stalking. In addition, it is revealed that there are individual differences in deterrent effects; the interaction effect between the perceived punishment and differential association with cyber stalkers is significant positive and the interaction effect between the perceived punishment and morality is also significant positive. That is, there are deterrent effect in low differential association with cyber stalkers and low morality. However, it is found that self control has no independent and interaction effect with the perceived punishment.
