소년사범을 위한 소규모 그룹홈의 활성화 방안

소년사범의 높은 재범률과 범죄의 흉포화, 저 연령화가 형사사법계는 물론 우리사회 전반의 큰 문제로 인식되고 있다. 이러한 상황에 직면하여 실무계를 중심으로 소년사범을 지역사회 내 소규모 개방시설에서 수용하는 이른바 그룹홈의 활용이 증가하고 있다. 6~10인 정도의 소년사범과 관리자가 함께 생활하는 가정형태의 그룹홈은 1호 처분에 해당될 수 있으며, 부모의 부재를 극복하고 지역사회와의 유대를 통해 소년사범을 올바른 방향으로 양육하는 것을 목표로 하고 있다. 그룹홈은 폐쇄형 소년원이 가지는 단점인 악풍감염, 낙인, 사회와의 단절을 최소화 할 수 있으며 개별처우와 단계처우가 가능하다는 장점이 있는 반면 전문적인 관리/감독이 이루어지지 않을 경우에 오히려 재범률이 높아질 수 있다. 본 연구는 현재 법적인 규정이 없는 상태에서 1호와 6호 처분으로 혼재되어 사용되고 있지만 지속적으로 그 활용도가 높아지고 있는 그룹홈의 필요성, 효과성, 현황과 문제점을 진단하였다. 이를 통해 향후 소년사범의 재범을 낮출 수 있는 장기적 관점의 범죄예방 전략으로서 그룹홈의 활용방안을 제시하였다.
Abstract
Faced with high recidivism of juvenile delinquents, a group home is considered an effective alternative. A group home is a small scale facility that houses 6~ 10 juvenile offenders. Located in communities, a group home is expected to reduce the drawbacks of closed juvenile detention centers, including stigmatization, weak social bonding, and negative influences of other juvenile offenders. In addition, as a community correction, group homes provide individual treatment based on need assessment. Accordingly, in Korean juvenile correction, in spite of the absence of relevant act, the use of group home for juvenile offenders are currently increasing. Among the 10 treatments, juveniles are assigned in group home under the 1st or 6th treatment. The current study investigates the needs of group homes, group homes’ history and development, effectiveness, and current situation and problems. Based on research results, the present study provides policy implications to help improve group homes as effective crime prevention strategies.
