최근 쾌적한 환경을 전망하면서 생활할 수 있는 권리에 대한 법적분쟁이 증가되고 있다. 그럼에도 불구하고 현행법상 조망권에 대한 법적 권리보호와 조망권의 법리에 대한 연구가 미흡한 실정이며, 건축법, 환경정책기본법 등에 규정된 일조권과 달리 명문으로 조망권에 대한 보호규정이 부재하여 조망권이 반사적 이익인지, 독자적 권리로서 법적보호대상이 되는 권리인지 논란이 되고 있다. 또한 조망권의 개념과 보호요건, 법적성질, 그 위법성 판단 기준 등이 학설과 판례에 의존하고 있는 실정이며, 법원 별로 조망권 침해에 대하여 다르게 판단되고 있어서 조망권에 대한 법적보장이 절실히 요구되고 있다. 본 논문에서는 우리나라의 현행법상의 조망권에 대한 법적보장의 현황을 살펴보고, 조망권의 독자적 권리성 인정문제, 조망권의 환경권으로서 한계와 제한, 조망권의 권리보호 강화와 조망권 분쟁의 최소화를 위한 입법문제, 위법성 판단기준 명확화 문제, 건축허가시 조망권 보호장치문제, 조망권 가치산정문제, 조망권 침해에 대한 준사법기관인 환경분쟁조정위원회의 역할문제 등을 공법적 관점에서 조망권의 법적과제를 고찰함으로써 조망권의 보호 강화와 분쟁최소화, 조망권 분쟁에 대한 권리구제의 신속성을 꾀할 뿐 아니라 인간의 존엄과 가치를 최대한 실현하고자 한다.
Abstract
Legal disputes of right to enjoy comfortable environment has been recently increasing. Nevertheless, legal protection of prospect right on the current law is lacking and as there is no protective regulation of prospect right unlike right of light prescribed on construction law and basic law of environmental policies, it has been argued that whether prospect right is reflective interest or it is the right having legal protection as the independent right. Since concept, protection conditions and legal property of prospect right, and its concrete standard depended on related theories and precedents, and courts ordered different judgements of violation of prospect right or judgment by lower courts was often reversed by high court or supreme court, legal security of prospect right is urgently required. This paper examines current status of legal security of prospect right on the current laws including construction law, basic law of environmental policies, environmental dispute arbitration law, housing law, and landscape act, and investigates recognition of independent right of prospect right, limitation and restriction of prospect right as environmental right, legal problems for strengthening protection of prospect right and minimizing disputes of prospect right, clarification of judgment criterion of illegality, protective device of prospect right in a building permit, value evaluation of prospect right, and security of prospect right by public law from the view of roles of environmental dispute arbitration committee, the quasi-judicial institution.
