본 글의 목적은, 1987년 제9차 헌법의 탄생을 통해 작동되고 있는 임시의정원과 임시헌장이 미친 ‘헌법제정권력의 권위’라는 정치적 유산을 찾고 그것의 확산 방향과 과제를 도출하는 데 있다. 이를 위해 다음과 같은 관련사항을 살펴보고자 한다. 첫째, 뢰벤슈타인의 헌법분류론과 마키아벨리의 정체순환론을 이론적으로 검토한다(제Ⅱ장). 둘째, 이러한 이론적 관점에서 1987년 제9차 헌법개정에 따른 제6공화국의 등장 의미를 1919년 3·1 운동의 헌법제정권력에 의해 탄생한 임시의정원·임시정부의 민주공화국의 정신계승과 연계하여 설명한다(제Ⅲ장). 셋째, 민주화 이후 민주공화국의 정신계승과 관련한 1919년 임시의정원·임시정부의 정치적 유산의 확산 방향과 과제에 대해 논의한다(제Ⅳ장). 넷째, 전체를 요약하고 글의 의의와 한계를 논한다(제Ⅴ장).
Abstract
The purpose of this article is to find the political legacy of the ‘authority of constitutional enactment power’ that the Provisional Diet and the Provisional Charter, which has been in operation since the birth of the 9th Constitution in 1987, came up with the direction and tasks for its expansion. To this end, we will look at the following related matters. First, Löbenstein’s constitutional taxonomy and Machiavelli’s stasis cycle theory are reviewed theoretically (Chapter II). Second, from this theoretical point of view, the meaning of the emergence of the 6th Republic following the 9th Constitutional Amendment in 1987 is explained in connection with the spiritual succession of the Provisional Assembly and the Provisional Government created by the constitution-making power of the March 1st Movement in 1919 (Chapter III). Third, the direction Assembly and tasks of spreading the political legacy of the Provisional Assembly and the Provisional Government in 1919 related to the spiritual succession of the democratic republic after democratization are discussed (Chapter IV). Fourth, the author summarizes the whole and discuss the significance and limitations of the text (Chapter V).
