제22대 총선을 통해 본 사전투표제의 대안 모색: 여당 후보자의 관점과 권리를 중심으로

본 연구는 제22대 총선에서 초선에 도전하는 여당의 후보자 관점, 그리고 관련법을 토대로 후보자의 권리 측면을 검토하여 사전투표제의 실질적인 가치를 확인하고 대안을 제시하는 데 목적을 두었다. 연구 결과 첫째, 유권자의 기본권인 선거권(참정권) 확대는 후보자가 선거운동을 할 수 있는 기본권이 축소되며, 둘째, 사전투표로 인해 선거운동 효과가 반감되고 선거운동에 제한을 받았으며, 셋째, 사전투표 때 발굴한 새롭고 중요한 이론(내용)을 지역 유권자 전체를 상대로 홍보할 수 없어 선거의 본질을 달성할 수 없었다. 이를 극복하기 위해 후보자의 기본권 축소 회복, 선거운동 효과의 반감과 제한 해소, 그리고 선거의 본질을 달성하기 위해선 사전투표제는 폐지되는 것이 바람직하다. 사전투표제의 대안으로 기존 부재자 투표제로 복귀하거나, 선거 당일 유권자가 타지에서 투표를 할 수 있도록 관련 법 개정과 투표용지 판별기가 지역, 선거구, 후보자를 인식하고, 기표란 도장을 인식할 수 있는 기술을 도입하여 선거 후 투표한 선거관리위원회에서 결과를 발표한다. 만약, 후보자가 재검표를 요구할 경우에만 해당 지역 투표지를 관할선거관리위원회에 배송하면 현행 선거비용보다 더 절약할 수 있을 것이다.
Abstract
This study aims to examine the perspectives of the ruling party candidates running for first-term in the 22nd general election and the candidates’ rights based on related laws, thereby confirming the practical value of the early voting system and suggesting alternatives. As a result of the study, first, the expansion of the right to vote, which is a basic right of voters, reduces the basic right of candidates to campaign; second, the effect of election campaigns is halved and restrictions are placed on election campaigns due to advance voting; third, the essence of the election could not be achieved because new content discovered during early voting could not be promoted to all local voters. In order to overcome this, it is desirable to abolish the early voting system in order to restore the reduction of candidates' basic rights, eliminate the animosity and restrictions on the effectiveness of election campaigns, and achieve the essence of elections. As an alternative to the early voting system, it is possible to return to the existing absentee voting system, or to revise related laws so that voters can vote from elsewhere on election day, and technology that allows the ballot discriminator to recognize the region, constituency, and candidate, and recognize the stamp on the ballot box. After the election, the Election Commission that voted will announce the results. If a candidate requests a recount, delivering the local ballot to the competent Election Commission will save more than the current election cost.
