독일의 학교법상 교육목적에 관한 일 연구: 베를린, 브란덴부르크, 노트라인 베스트팔렌 주의 학교법을 중심으로

본 연구는 독일의 학교법(school law) 상에 규정된 교육목적의 특성과 의미에 대해 살펴보고자 한다. 이를 위하여 독일의 베를린(Berlin), 브란덴부르크(Brandenburg) 및 노트라인 베스트팔렌(Nordrhein-Westfalen) 주의 학교법을 중심으로 교육목적을 각각 살펴보았다. 본 연구에서 도출된 두 가지 주요 연구 결과들을 살펴보면 다음과 같다. 첫째, 독일의 주별 학교교육의 목적들은, 개인적 차원보다는 사회 공동체 속에서 더불어 살아가기 위한 공존의 자질과 역량을 함양하는 사회적, 내재적인 교육목적이 선행된다 할 것이다. 둘째, 독일의 학교법상 교육목적은 법적으로는 연속성을 보이고, 내용적으로는 구체성을 바탕으로 규정되어 있음을 알 수 있다. 이를 바탕으로 우리나라의 교육문제의 기초로 교육목적의 명확성, 구체성, 지속성, 실천성에 대한 교육적 논의와 사회적 합의가 필요한 것으로 보는 바이다.
Abstract
This study aims to examine the characteristics and meaning of educational purposes stipulated in the German school law. For this purpose, the educational objectives stated in the school laws of the German states of Berlin, Brandenburg, and North Rhine-Westphalia were analyzed. The two main research results derived from this study are as follows. First, the educational purposes of each state in Germany are preceded by social and intrinsic educational purposes that foster the qualities and capabilities of coexistence for living together in a social community rather than individual ones. Second, it can be seen that educational purposes under the German school law are legally continuative and are stipulated based on specificity in terms of content. Based on this, it is believed that educational discussions and social consensus on the clarity, specificity, continuity, and practicality of educational purposes are necessary as the basis for educational issues in Korea.
