Abstract

With the emergence of artificial intelligence capable of creating art indistinguishable from or vastly superior to that of humans, the question arises: should artificial intelligence be granted the rights of a creator, namely copyright? This paper seeks to answer that question philosophically, rather than through legal or media studies approaches. The method involves examining whether artificial intelligence possesses moral status, since for AI to hold copyright, it must be a moral agent, and moral agents require moral status. I propose sentience as the necessary and sufficient condition for moral status. I acknowledge the counterargument that this criterion favors entities that “lack intelligence but possess sentience” while disadvantaging those that “lack sentience but possess intelligence.” Consequently, I explore why sentient beings should be considered morally. The conclusion is that to possess moral status, an entity must either have sentience or, even if interpreted more broadly, the capacity to care about what happens to itself. Since artificial intelligence lacks such capacity, it lacks moral status. Therefore, artificial intelligence cannot possess rights, including copyright.
