Abstract

This study examines the transition from 'confession recording final judgment documents(自白直敍結案)' to 'interrogation editing final judgment documents(審問編輯結案)' in late Joseon to investigate how the principle of mandatory confession (自白必須主義), the structural core of Joseon's criminal justice system, gradually relaxed. Joseon was fundamentally based on mandatory confession requiring defendants' confessions as essential, and created final judgment documents by recording confessions verbatim. The creation process involved multiple verification stages and official observation to prevent manipulation through objective procedures. This institutional mechanism ensured that 'recording confessions to create final judgment documents' operated as principle until King Yeongjo's (英祖) reign in the 18th century. From King Jeongjo's (正祖) reign onward, this principle began changing. When final judgment document creation became difficult due to defendants refusing confession or dying, the state gradually abandoned absolute dependence on 'confession recording final judgment documents'. By relaxing compositional conditions, the state began editing or combining interrogation content to produce final judgment documents and securing legal validity through defendants' consent. This phenomenon extended throughout the 19th century as sustained institutional development. From late 18th to late 19th centuries, 113 cases over approximately 100 years confirmed various methods: inserting state-edited interrogation content into final judgment documents, creating final judgment documents directly from interrogation content, recording identical content across multiple defendants' final judgment documents, and collectively gathering multiple defendants' final judgment documents. Notably, Joseon made efforts to suppress arbitrary judgments and secure objectivity based on testimonies. 'Interrogation editing final judgment documents' comprehensively recorded various evidence including defendants' confessions, witness testimonies, and physical evidence, thereby excluding arbitrary judgments. Consequently, late Joseon transformed final judgment document operation from 'confession recording' to 'interrogation editing,' resolving administrative chaos and evolving toward greater efficiency.
