대통령 선거공약의 입법화에 관한 연구: 김영삼~노무현 대통령을 중심으로

대통령의 선거공약은 집권 이후 대통령이 추진하는 정책의제의 주요 원천이 되며, 대통령은 집권의정당성 확보, 정치적 자본의 확충 등을 위해 선거공약의 정치적 실현에 많은 노력을 기울인다. 본 연구는김영삼~노무현 대통령이 국회에 제출한 선거공약법안 834개를 대상으로, 이들 선거공약법안의 국회 통과여부에 ‘대통령의 입법리더십’, ‘대통령의 자원’, ‘입법환경’ 등이 어떤 영향을 미쳤는가를 분석했다. 대통령의 입법리더십 측면에서 대통령과 여야 의원의 만남은 대통령이 의원들을 상대로 정치적기술을 발휘하는 기회이지만, 이러한 만남의 효과가 김영삼, 노무현에게는 나타나지 않았고, 김대중의경우에는 선거공약법안의 국회 통과에 부정적이었다. 대통령의 자원 중 입법지원조직의 규모 확대는 선거공약법안의 국회 통과에 긍정적 영향을 미쳤다. 그러나 대통령 지지율이 높아질수록, 또 대통령에 대한 부정적 사설이 감소할수록 선거공약법안의국회 통과 가능성은 낮아졌다. 이처럼 의원들의 의사결정이 여론과 반대방향으로 이뤄지는 것은의원들의 낮은 반응성 때문인데, 여기에는 대결과 갈등의 정치문화, 의원들의 제한된 자원,중앙집권적 정당구조, 폐쇄적인 법안심의제도 등이 영향을 미친 것으로 판단된다. 입법환경 측면에서 여대야소일 때, 당청갈등이 적을수록 선거공약법안의 국회 통과 가능성이높아졌다. 그러나 임기 후반으로 갈수록 선거공약법안의 국회 통과가 어려워져 대통령이 높은우선순위를 갖고 추진하는 정책일수록 임기 초반에 서둘러야 함을 시사한다. 전체적으로 대통령 선거공약의 국회 통과에는 대통령의 개인적 요인보다 입법환경과 같은 구조적요인의 영향력이 더 컸다. 이는 대통령과 의회 관계에서 대통령의 개인적 자질이나 특성을 강조하는기존의 자질론적 접근방법 또는 대통령 중심 시각의 한계를 보여주는 것이다.
Abstract
The aim of this study is to analyze how factors influencing relationship between presiednt and congress, which include presidential legislative leadership, president's resources and legislative environment, effected on the legislation of presidential campaign promises. To do this, I collected 834 bills containing presidential campaign promises, which were submitted from Kim Young-sam administration through Roh Mu-hyun administration. These bills formed as much as 52.7 percent of bills containing policy agendas of presidents,which meaned that presidential campaign promises were crucial to the formation of policy presidents pursued. It was found that as for Kim Young-sam and Roh Mu-hyun, the meeting between the president and lawmakers, where presidents is believed to give full play to the political skills,had no effect on passing of bills related to presidential campaign promises, but as for Kim Dae-joong, it had the negative effect. Meanwhile, as the size of organization to help the legislative activities of presidents got bigger, more bills were passed. But as the approval rate of the incumbent presidents rose and the amount of newspaper editorials containing a negative views of the presidents reduced, less bill were passed, which resulted from the fact that the lawmakers hardly responded to voters'needs and complaints. In terms of legislative environment, the unified government and the reduction of conflict between presidents and ruling party had the positive effect. But as the presidents' term was coming to an end, these bills were difficult to pass. In sum, the factors related to presidents' competence, like political skill and characters, had www.kipa.re.kr 177less influence in passing bills containging presidential campaign promises than the factor related to legislative environment. This finding might suggest that the presidency-centered perspective,which emphasized on presidents' competence, have limitation to understanding the dynamics of relationship between president and congress.
