본 연구는 지방자치단체 출자･출연기관의 성장 실태를 확인하고, 이들 기관을 효과적으로 관리하기 위한 제도적 개선방안을 제시하는 데 목적이 있다. 이를 위하여 출자･출연기관의 실태는 설립, 업무, 재정, 인력 등의 네 가지 요소로 구분하고, 기관수, 인력규모, 예산현황 등의 양적인 측면과 설립근거, 업무성격, 기관장의 자질, 재원조달방법 등의 질적인 측면을 분석하였다. 더불어, 출자･출연기관이 나타내는 문제점과 한계로부터 제도적 개선방안을 검토하였다. 분석결과, 출자･출연기관의 발전과 효과적 관리를 위한 제도적 개선점으로, 출자기관과 출연기관에 대한 명확한 법적정의 및 사업영역의 구분, 출자･출연기관 지정기준에 추가지정 신설, 설립･운영타당성 검토를 위한 전문기관 의뢰 강제 및 전문기관의 명확한 기준제시, 경영평가의 강화, 기관장 채용을 위한 자격요건의 의무화, 기관장 추천위원회를 통한 기관장 후보자의 복수추천, 지방의회의 기관장 인사검증, 공직자윤리법의 취업제한 기업분야에서 지방준정부조직까지의 확대 등을 제시하였다.
Abstract
The purpose of this study is to analyze the growth status of the local government-invested and -funded institutions and present the institutional improvements to effectively manage such institutions. We have categorized the growth status of invested and funded institutions into four aspects－establishment, task, finance, and human resource－and then analyzed the quantitative aspects(e.g., the number of institutions, manpower scale, budget scale) as well as the qualitative aspects(e.g., establishment basis, task personalities, qualities of institutional heads, financing methods) of such institutions. Also, we have examined the institutional improvements from the growth status of invested and funded institutions. As a result, we suggest the following institutional improvements for development and effective management of invested and funded institutions: a clear legal definition of invested and funded institutions, classification of task types, enforcing a contract with specialized agency for validity examination of establishment and operation and defining clear criteria of specialized agency, strengthening of management evaluation, appointment of institutional heads that meet needed qualifications, multiple candidates for institutional heads recommended by the nomination committee, qualification inspection for institutional heads by the local assembly, and expanding the restrictions of the employment of retired public officials as per the Public Service Ethics Act to the local quasi-governmental organization.
