제정노동쟁의조정법상 쟁의행위규제에 대한 이해

노동조합및노동관계조정법 하에서 한국 노동자들은 헌법이 보장한 노동기본권의 행사가 심각하게 제한받고 있다. 노동기본권의 행사가 예외적으로 보장되고 있다. 이 글에서 제정노동쟁의조정법상 쟁의행위규제에 대하여 검토하였다. 현행 노동조합 및 노동관계조정법상 쟁의행위조항은 과거 노동쟁의조정법, 노동조합및노동관계조정법에서 비롯된 것이다. 쟁의행위규제에 관한 조항은 1953년 제정된 노동쟁의조정법에서 출발한다. 이 글에서는 제정노동쟁의조정법에 관한 국회 제정심의 및 쟁의행위규제에 관하여 살펴보았다. 그리고 현행 노동조합 및 노동관계조정법상 쟁의행위규제의 실체에 대하여 파악하여 보았다. 그 결과 제정노동쟁의조정법상 쟁의행위의 규제의 대상이 현행 노동조합 및 노동관계조정법보다도 적고 규제의 수준도 훨씬 약하다는 것을 인식할 수 있었다.
Abstract
Under the “Trade Union and Labor Relations Adjustment Act”, Korea's laborers are thoroughly restricted in the use of their fundamental Labor Rights that the Constitution of the Republic of Korea guarantees. The Use of fundamental Labor Rights is secured exceptionally. In this essay I have studied the regulation of industrial action in the “Established Industrial Disputes Adjustment Act”. Articles of industrial action in the current “Trade Union And Labor Relations Adjustment Act” originated in the abolished Acts, namely Industrial Disputes Adjustment Act and Trade Union And Labor Relations Adjustment Act. Articles on regulation of industrial action originated in Industrial Disputes Adjustment Act established in 1953. In this essay I have studied the consideration in the National Assembly for establishment by law on the established Industrial Disputes Adjustment Act, the regulation of industrial action on the Act. And I have investigated the true nature of the regulation of industrial action in the existing Trade Union And Labor Relations Adjustment Act in this essay. So In this essay I was able to recognize the fact that the number of the regulated articles of industrial action in the established Industrial Disputes Adjustment Act is less than the existing Trade Union And Labor Relations Adjustment Act.
