주요방위산업체 종사 근로자의 단체행동권 보장에 관한 연구

대한민국 헌법 제33조 제1항은 근로자의 노동3권인 단결권, 단체교섭권 및 단체행동권을 헌법상 보장된 기본적 권리로 명시하면서, 동조 제3항에서 법률이 정하는 바에 의하여 주요방위산업체에 종사하는 근로자의 단체행동권을 제한하거나 인정하지 아니할 수 있다고 규정하고 있다. 따라서 이렇게 단체행동권을 제한받는 근로자들에게는 그러한 권리를 행사하는 것과 유사한 효과를 도모할 수 있는 대상조치가 부여되어야 할 것이다. 그러나 현행 노동조합법은 이에 대한 특별한 고려를 하고 있지 않다는 점에서 문제가 있으므로 이를 보완할 수 있는 적절한 대상조치가 필요하다. 현행 노동조합법은 조정, 중재, 긴급조정 등의 조정 제도를 두고 있으나 이러한 제도들은 단체행동권 제한에 대한 충분한 대상조치라고 보기 어려운 측면이 있으므로 각 제도의 보완 또는 새로운 제도의 도입이 필요하다.
Abstract
Article 33 paragraph 1 of the Constitution of the Republic of Korea stipulates that workers shall have the right to independent association, collective bargaining and collective action as basic rights guaranteed by the Constitution. And Article 33 paragraph 3 stipulates of the Constitution that the right to collective action of workers employed by important defense industries may be either restricted or denied under the conditions as prescribed by Act. Workers employed by important defense industries should be given compensatory measures that can have a similar effect as exercising right to collective action. However, the Trade Union and Labor Relations Adjustment Act does not have any special consideration for that. Therefore, appropriate compensatory measures are needed to compensate for this. The Trade Union and Labor Relations Adjustment Act has a system of mediation, arbitration and emergency adjustment, but each system should be supplemented or new system is needed.
