무국적관련 국제협약과 한국법의 비교

무국적자의 지위와 관련하여 기본적인 국제문서로서 ‘무국적자의 지위에 관한 협약’(Convention relating to the Status of Stateless Persons)이 있으며, 이 무국적자협약은 무국적자가 기본적 권리와 자유를 누릴 수 있도록 하는 데에 주안점을 두고 있다. 이 협약을 주목해야 하는 이유는 한국이 가입했다는 점이다. 한국은 협약이 발효된 직후에 가입서를 기탁함으로써 1962년 11월 20일부터 적용을 받았다. 그러나 한국이 무국적자협약에 가입했음에도 불구하고 한국 정부와 국회는 그 협약을 이행하기 위한 아무런 조치를 지금까지 취하지 못해 왔다. 이 글은 무국적자에 대한 국제협약과 한국법의 내용을 비교하는 것을 목적으로 한다. 그렇게 함으로써 한국이 앞으로 국내법상의 이행조치를 준비하고 실천함에 있어서 참고가 되고자 한다. 무국적자의 보호는 국내법상 외국인의 정의에 무국적자를 포함시키는 데에서 출발해야 한다. 학자들은 무국적자도 외국인에 포함된다고 해석하지만, 한국의 관련 법령이나 집행 관행을 보면, 무국적자를 외국인의 한 부류로 인정하지 못하고 있다. 예를 들어, 신분증명서 발급의 전제가 되는 외국인등록의 경우도 국적이 있는 외국인을 전제로 제도가 운용되어 왔으며, 신분증명서(외국인등록증)의 발급도 마찬가지이다. 한국에서는 혼인신고를 해야만 혼인이 법률적으로 성립하게 된다. 혼인신고가 매우 중요하나, 무국적자는 법률상으로나 실무상으로 혼인신고가 불가능하게 되어 있다. 그리고 이 글에서는 무국적자감소협약과 한국법의 비교에 대해서도 여러 지면을 할애했으며, 어린이의 등록ㆍ성명권 그리고 국적취득권과 한국법현실에 대해서도 비교를 해 보았다. 한국의 현재 국적법은 1997년 개정 이전 국적법에 비하여 무국적자의 발생 여지를 많이 줄이고 있으나, 무국적자감소협약과의 사이에는 적지않은 차이점이 있다. 그리고 무국적자의 감소와 아동의 인권 등을 위해서 어린이의 등록ㆍ성명권 등이 보장되어야 하나, 어린이들이 무국적 상태로 빠져 버릴 수 있는 위험을 충분히 제거하지는 못하고 있다.
Abstract
The ‘1954 Convention relating to the Status of Stateless Persons’ is a basic international document on stateless persons. The aim of this Convention is to make stateless persons enjoy fundamental rights and freedom as human beings. As the Republic of Korea adhered to this Convention in 1962, we should give attention to this Convention. But it seems that Korea has not yet taken necessary measures for practical implementation of this Convention, concluding the issue of statelessness status determination. In Korea, the marriage cannot be established legally without report of marriage. The report of marriage is very important, but it is impossible for stateless person to report lawful wedlock both in legislation and practices. In this thesis, it is proposed how Korea can incorporate a lot of provisions of this Convention into its domestic legislation. We are able to start incorporation from inclusion of stateless persons in the definition of non-citizen(foreigner) in related Acts. The Korean government has not signed ‘the 1961 Convention on the Reduction of Statelessness’, which is of importance for the stateless persons, too. And, this thesis explored the extent to which relevant Korean legislation accords with the provisions set out in 1961 Convention. There are some gaps in issuing identity papers between the 1961 Convention and Korean legislation.
