무국적 탈북자 보호를 위한 법제도적 대응 방안 모색

국적은 개인에게 국내법, 국제법, 국제사법등에 있어 여러 가지 중요하고 다양한 기능을한다. 이 같은 시각에서 이 글에서는 중국 남성과 탈북 여성 사이에서 태어난 탈북 아동과 화교출신 탈북자를 대상으로 무국적 탈북자 보호를위한 법적인 차원의 개선 방안을 모색해 보았다. 중국 내 탈북아동과 국내 무국적 탈북자들을 법률상의 무국적자가 아닌 사실상의 무국적자로간주하는 것을 논의의 시발점으로 삼았다. 중국 내 탈북 아동의 법적인 보호를 위해서는 중국의 국내법과 아동권리협약을 비롯하여중국이 가입하고 있는 국제인권조약을 준수하도록 촉구해야 한다. 동시에 재중 탈북자들의보호를 위한 우리 정부 당국의 외교역량이 강화되어야 한다. 또한 재중 무국적 탈북 아동이국내에 들어와 북한이탈주민지원법의 적용을받기 위해서는 관련 규정들을 개정할 필요가있다. 무국적 탈북자들이 대한민국 국적을 인정받는 과정에서 부딪히는 가장 큰 어려움은 북한출신이라는 점을 그들 스스로 입증해야 한다는점이다. 따라서 국적법상의 국적판정 제도가개선되어야 한다. 또한 북한 국적을 버리고 중간에 중국 국적을 취득한 것이 외국국적의 자진취득에 해당하지 않는다는 점을 명시할 필요가 있다. 그리고 2010년 5월 국적법을 개정하면서 이중국적 제도를 도입하였는데 이 내용이북한이탈주민지원법에 반영되어 있지 않다. 따라서 개정 국적법과 북한이탈주민지원법이 합치되도록 북한이탈주민지원법의 관련 규정이개정되어야 한다.
Abstract
Nationality plays an important role to individual persons in municipal law, public and private international law. In this paper, I endeavor to analyze the legal problems concerning the nationality of North Korean defectors in China and South Korea and suggest some measures to improve their situation. Stateless persons can be distinguished as de jure stateless persons and de facto stateless persons. I regard stateless North Korean defectors as de facto stateless persons. To protect stateless children who were born from Chinese fathers and North Korean mothers in China, we shall request the Chinese government to observe its domestic law and the international human rights treaties which China acceded or ratified. At the same time, the Korean government shall strengthen it diplomatic ability. On domestic level, some provisions of North Korean Defector Support Law shall be revised. The most difficult legal problem which stateless North Korean defectors have confronted is that they must provide evidence that they were born in North Korea. For stateless North Korean defectors, provisions concerning judgment of nationality specified in the Nationality Law shall be revised. Also, it is necessary to clearly stipulate that the denunciation of North Korean nationality and acquisition of Chinese nationality is not a voluntary acquisition of foreign nationality. Meanwhile, the Nationality Law adopted dual citizenship in 2010. However, the dual citizenship clause of the Nationality Law is not reflected in the North Korean Defector Support Law. To coincide with the dual citizenship,the definition clause of the North Korean Defector Support Law shall be revised or a new clause shall be enacted.
