한국에서 출생한 난민아동의 출생등록을 위한 입법론적 검토

초록

2019년 아동권리위원회는 아동권리협약 제7조에 근거하여 대한민국 정부를 상대로 “온라인 출생신고를 포함한 출생신고가 부모의 법적 지위 및 출신지와 관계없이 모든 아동이 보편적으로 이용･가능하도록 보장할 것”을 권고한 바 있다. 또한 인종차별철폐위원회도 2012년 “당사국에서 태어난 난민, 인도적 지위 체류자 및 난민신청자의 자녀, 그리고 미등록 이주민 자녀의 출생을 적절히 등록할 제도와 절차를 마련할 것”을 권고하였으며, 2018년에도 계속해서 보편적 출생등록신고제의 도입과 더불어 난민과 관련된 여러 가지 사항에 대해서 개선할 것을 권고한 바 있다. 그러나 우리나라는 아동권리협약을 비준한 국가이고 난민법을 제정한 국가이지만 아동권리위원회의 계속되는 보편적 출생등록제도에 도입에 대한 권고에도 불구하고 이를 실천하지 못하고 있다. 이에 본 논문에서는 한국에서 출생하였으나 제도적 결함으로 인해 출생신고를 하지 못하고 있는 난민아동의 출생등록을 위한 가능성을 모색해 보았다. 이를 위해 우선적으로 현재 우리나라의 난민아동의 출생신고에 대한 현황과 현행 출생신고제도를 파악하기 위하여 한국인 및 외국인 부모 사이에서 출생한 아동의 출생신고가 어떻게 이루어지고 있는지 검토하였다. 계속해서 독일의 난민아동의 출생등록에 관한 현황과 입법례 등을 검토하였다. 독일은 보편적 출생제도와 출생통보제도를 실행하고 있으며, 2015년 100만 명이라는 많은 난민을 수용하면서 난민아동의 출생등록문제를 제도적으로 보완해 오고 있다. 이에 독일의 사례를 검토하므로 시사점을 찾고자 하였다. 마지막 부분에서는 한국에서 출생한 난민아동의 출생등록 가능성을 위한 입법론적인 방안을 제시해 보았다. 이에 가족관계등록법의 일부개정 혹은 특별법을 제정이라는 입법방식의 문제, 난민인 부모가 처한 특수한 상황에서 출생신고 시 누락될 수 있는 제출서류에 관한 문제, 국적에 관한 문제, 출생등록과 체류자격과의 관련성의 문제, 현행법에서의 출생등록과 관련된 공무원의 통보의무에 관한 문제 그리고 출생등록과 함께 야기되는 부수적인 의료혜택, 예방접종, 건강권 등을 골자로 하여 관련 사항들을 검토하였다.

Abstract

Even after acceding to the Convention Relating to the Status of Refugees and the Protocol Relating to the Status of Refugees in December 1992, Korea enacted an independent Refugee Act in 2012, and this Act has been in force since July 1, 2013. The purpose of enactment of the Refugee Act is to accommodate various types of refugees arising from the world situation and to protect them in terms of international human rights law. Therefore, ensuring that refugee children born in Korea can be registered according to the Family Relations Registration Act is a responsibility that the country that enacted the Refugee Act must fulfill, and as Korea ratified the UN Convention on the Rights of the Child, children’s rights It is also in line with the obligation to realize Articles 2, 7 and 8 of the Convention. In Korea, in 2019, the Committee on the Rights of the Child challenged the government of the Republic of Korea based on Article 7 of the Convention on the Rights of the Child to “ensure that birth reporting, including online birth reporting, is universally available and available to all children regardless of parents’ legal status and place of origin.” In addition, in 2012, the Committee on the Elimination of Racial Discrimination also recommended that “systems and procedures be established to properly register the births of refugees, children of humanitarian status holders and refugee applicants, and children of undocumented migrants born in the country concerned.” In 2018, it was recommended to continue to improve various issues related to refugees along with the introduction of the universal birth registration system. In this paper, in order to examine the possibility of birth registration of refugee children, first of all, the birth registration system for refugee children in Germany was reviewed. Referring to the implications of the German system, the possibility of birth registration of refugee children and foreign children born in Korea was reviewed in detail.
