Abstract
There is no question that the existence of regional human rights courts and commissions has been an essential element in the enforcement of international human rights in those regions of the world where such tribunals exist. In Asia region, however, there is no such body. Although there is ASEAN Declaration on Human Rights, it cannot be seen as a significant enforcement tool in this area of law and policy. Many reasons have been offered for the absence of a regional human rights tribunal in Asia, what is clear is that the lack of such a court or commission has been a major impediment in the movement to enforce human rights including rights of persons with disabilities in Asia. The need of such a body has further intensified since the ratification of Asian states of the United Nations Convention on the Rights of Persons with Disabilities(CRPD). The CRPD clearly establishes the international human and legal rights of persons with disabilities. But in order for it to be more than a mere paper victory, it must be enforced through a human rights body. Only then, can we begin to be optimistic about the real-life impact of the CRPD on the rights of persons with disabilities in Asia region. The creation of a Disability Rights Commission for Asia(DRCA) would be a necessary step leading to easement of disabilities deprivation. It would be an active, innovative, progressive, and pivotal step on the path towards realization of these rights. It would also be a likely inspiration for a full regional human rights tribunal in this area. If it were created, however, it is also clear that it would be an empty victory without available and well-informed lawyers to represent persons with disabilities seeking remedies.
