북한의 ‘장애인권리협약 국가이행보고서’ 분석

본 연구의 목적은 북한의 UN 장애인권리협약 국가이행보고서의 주요쟁점을 분석하고, 협약 이행을 평가하는 것이다. 이에 본 연구는 동 보고서를 ① 장애인 현황, ② 장애인의 존엄성, 자율성 및 자립에 대한 존중, ③ 장애인의 비차별과 기회의 균등, ④ 장애인의 완전하고 효과적인 사회참여 및 통합, ⑤ 장애 차이 존중, 장애인의 인정 및 보호, ⑥ 접근성, ⑦ 남녀의 평등, ⑧ 장애아동 권리 존중, ⑨ 국제협력 등을 중심으로 고찰하였다. 분석결과, 북한은 협약가입 이후 장애인권리를 위한 노력을 한 바 있으나, 장애인권리에 대한 전반적인 인식차원에서는 과거와 뚜렷한 차이가 나타나지 않았다. 다시 말해, 북한은 장애인권리협약 가입 이후 북한의 부분적 개선과 징후는 보이지만 그렇다고 이것이 전체적인 북한 장애인권리 분야의 발전을 크게 선도하지는 못했다고 평가할 수 있다. 이에 북한의 장애인권리 협약 이행을 위한 향후 과제를 제시하면 다음과 같다. 첫째, 북한의 장애인권리 개선 및 보장과 관련한 법령의 ‘체계화’와 ‘미시화’가 필요하다. 둘째, 북한 장애인권리와 복지 향상을 위한 ‘특별법’제정이 필요하다. 셋째, 북한의 장애인권리 강화에 대한 북한의 자체 평가가 필요하다. 전술적 차원으로, 넷째, 북한 스스로 장애인권리협약 이행을 위한 중장기 발전계획 수립이 필요하다. 다섯째, 북한장애인 주무기관과 장애인 전문 국제기구와의 공조가 필요하다. 여섯째, 남한장애인 민간단체와의 인적 물적 협력을 포함한 다방면의 교류가 필요하다.
Abstract
The purpose of this study is to analyze the major issues and evaluate the Initial Report of North Korea on the Implementation of the Convention on the Rights of Persons with Disabilities. Therefore, the analysis subjects based on the General principles of the Convention and description order of the study are as follows; ① current status of the disabled in North Korea ② respect for dignity, autonomy, and independence of the disabled ③ non-discrimination and equality of opportunity ④ full and effective participation and inclusion in society ⑤ respect for difference and acceptance of persons with disabilities ⑥ accessibility ⑦ equality between men and women ⑧ respect for the right of children with disabilities ⑨ international cooperation. As a result of analysis, North Korea has made efforts to protect the rights of the disabled since the signing of the Convention, but there has been no noticeable difference from the past in terms of overall recognition of the rights. In other words, North Korea has shown partial improvement and signs, but it cannot be assessed that it led much development of the overall rights for the disabled in North Korea. Therefore, future tasks for the implementation of the Convention on the rights of persons with disabilities of North Korea are as follows. First, ‘systematization’and ‘departmentalization’of laws and regulations related to the improvement and guarantee of the rights of the disabled in North Korea are needed. Second, it is necessary to enact a ‘special law’to improve the rights and welfare of the disabled in North Korea. Third, North Korea’s self-evaluation of strengthening the rights of persons with disabilities is needed. Fourth, North Korea itself needs to establish a mid- and long-tern development plan for the implementation of the Convention. Fifth, cooperation between North Korean authorities dealing with disabilities and international organizations specialized in handicapped persons is necessary. Sixth, multifaceted exchanges including human and material cooperation with NGOs with disabilities in South Korea are needed.
