국제인권조약으로 본 장애인 탈시설 권리의 정당성과 정책적 함의

이 연구의 목적은 장애인 탈시설 정책의 규범적 근거를 종합적으로 검토하여 한국의 법제도와 관련된 시사점을 도출하는 것이다. 이를 위해 한국 정부가 가입하고 비준한 8개의 주요 국제인권조약 중 장애인권리협약을 제외한 7개의 조약과 부속문서를 검토하였다. 연구 결과 모든 조약에서 장애인 탈시설 권리의 당위성과 관련 정책 마련을 위한 규범적 근거가 확인되었다. 특히 장애인 탈시설 권리의 구체적 의미는 여러 인권조약 간의 관계적 맥락에서 해석될 수 있다는 점을 발견할 수 있었다. 이 연구는 한국 사회가 장애인권리협약을 비롯한 모든 국제인권조약에 근거하여 장애인 탈시설 권리의 정당성을 인식해야 한다고 주장하면서 국가 차원에서 고려해야 할 행정적, 입법적, 사법적 조치를 제안하였다.
Abstract
The purpose of this study is to comprehensively examine the normative basis of deinstitutionalization policies for persons with disabilities and to derive implications for the legal system in Korea. To achieve this, we analyzed eight major human rights treaties that the Korean government has ratified, along with the associated annexes of each treaties. The review revealed that all treaties contain normative grounds for the legitimacy of the right to deinstitutionalization for persons with disabilities and the establishment of related policies. In particular, it was found that the specific meaning of the right to deinstitutionalization can be interpreted within the relational context of various human rights treaties. This study argues that Korean government should recognize the legitimacy of the right to deinstitutionalization based on international human rights treaties, including the Convention on the Rights of Persons with Disabilities. Furthermore, it proposes administrative, legislative, and judicial measures that should be considered at the national level.
