장애인권리협약의 국내적 이행 상황 검토

오늘날 세계 각국은 장애인에 대해 법적인 지위를 부여하고 이들의 권리를 인권과 기본권의 차원에서 보장하고자 노력하고 있다. 최근 우리나라도 UN의 「장애인의 권리에 관한 협약」에 가입하였다. 이를 계기로 국내의 장애인 인권 보장의 수준이 한 층 더 향상될 것으로 기대되고 있다. 실제로 장애인권리협약의 국내법적 이행을 위하여 그간 법제도에 있어서 일정 정도의 진전이 있었던 점은 인정할 수 있다. 특히 장애인차별금지법의 제정과 시행은 장애인에 대한 차별의 관행을 시정하는 데 있어서 획기적인 전기를 마련해주었다고 할 수 있을 것이다. 하지만 아직도 장애인에 대한 인권침해를 초래할 수 있는 국내의 법령이 산재해 있고, 장애인권리협약의 이행을 위한 제도적 개선의 노력이 실효를 거두지 못하고 있는 경우가 많다. 법령에서 장애인의 인권침해를 명시적으로 금지하고 있음에도 불구하고, 장애인에 대한 노골적인 냉대나 무형적인 차별, 사실상의 배제와 접근 차단이 노골화되는 경우가 적지 않으며, 장애인에 대한 성적 착취나 학대 등은 더욱 심각한 양상으로 나타나고 있음을 볼 수 있다. 장애인권리협약의 효과적인 이행을 위해서는 우선 국내의 관련 법령을 보다 실효성 있게 개선하여야 하고, 나아가 관련 법제의 집행 상황에 대해 국가가 적극적으로 감독활동을 펼쳐나갈 필요가 있다. 장애인권리협약의 효과적인 이행을 촉진하기 위해서 선택의정서의 비준이 필수적이라고 본다.
Abstract
Disabled persons have the inherent right to respect for their human dignity and the same fundamental rights as their fellow-citizens. Disabled persons have the same civil and political rights as other human beings and shall be protected against all exploitation. The United Nations Convention on the Rights of Persons with Disabilities(UN CRPD) was adapted in 2006 and entered into force in 2008. Korea acceded to the Convention on the Rights of Persons with Disabilities in 2009. This study examines the implementation of UN CRPD and the improvement of the acts and subordinate statutes in Korea. As Disability Relevant Legislations there are Welfare for Disabled Persons Act, Promotion of Employment and Vocational Rehabilitation of Disabled Persons Act, The Act on Installation of Convenience Facilities for the Disabled, The Act to Narrow the Digital Divide, Disability Discrimination Act etc. The crucial elements of Disability Discrimination Act aim to ensure the substantial anti-discrimination and rights of people with disabilities based on establishment of punishing action for damage and a class action, but the application of this law is restricted to the important discriminations and damages. But these Disability Relevant Legislations is not sufficient to ensure Rights of Persons with Disabilities. It is necessary to improve policies for the implementation of the United Nations Convention on the Rights of Persons with Disabilities hereafter.
