한국전쟁은 그 발발만이 아니라 지속도 지극히 부조리한 것이었다. 한국전쟁의 휴전회담은 너무 늦게 시작되었다. 본격적으로 휴전회담이 개시된 것은 1951년 7월, 즉 전쟁이 시작된 후 1년이 지나서였다. 또한 휴전회담은 너무 오래 걸렸다. 휴전회담은 2년여를 끌었다. 핵심적인 논란은 바로 포로 송환의 문제였다. 포로송환의 원칙을 둘러싼 논쟁으로 다시 무의미한 살상과 파괴의 시간은 계속되었다. 이 글은 한국전쟁을 통하여 ‘확전 금지와 신속 종결’이라는 전쟁 종결의 대원칙을 생각해 보고자 한다. 그리고 그를 통해 한국전쟁의 부정의를 얘기하고자 한다. 한국전쟁은 전선을 계속 확대하여 새로운 전쟁을 만들어 갔다는 점, 휴전 협상의 개시가 늦었다는 점, 휴전 협상에서 군사분계선과 비무장지대에 대한 합의를 보았음에도 전투를 중단하지 않았다는 점, 포로송환에 관한 새로운 윤리적 원칙을 제기하여 휴전 협상의 조기타결을 방해하였다는 점, 휴전 협상을 강요하는 수단으로 과도한 공중폭격을 행사하고, 심지어 핵공격의 위협까지 하였다는 점 등에서 전쟁 종결의 부정의로 점철된 전쟁이었다고 할 것이다.
Abstract
This essay is on the injustices in the settlement of the Korean War. The Korean War is called “a wrong war”. The wrongs layed not only in the initiation and in the conduct, but also in the ending of the war. The characteristic injustice of the Korean War is the absurd prolongation of the war. The war should have been ended earlier and the time delayed was a mere massacre. This essay posits three facets of the injustice of the Korean War settlement. First, the cease-fire or armistice negotiation was set to work too late. The United States and the Communist China should not have escalated the war and should have accommodated a compromise with each other even earlier. Second, they should have stopped fighting after having reached an agreement of the demarcation line. Nonetheless, the U. S. army insisted on continuing the battle. Third, the administration of the U. S. made the non-forcible repatriation of prisoners of war(POWs) as ideological combat. The Truman administration and the American military wanted a token of their victory. Their stubbornness was the principal culprit which lengthened the war and increased the sacrifices in the Korean Peninsula. The Korean War is a convincing example which shows the necessity that just settlement of war should be more seriously considered in the category of the “jus post bellum”.
