Abstract
This article aims at examining the issue of democratic legitimacyof judicial review, as a means of evaluating merits and demerits ofthe constitutional court system in Korea. For this, I focused on thedebates over the issue in the United States that have beencontinuing for over 200 years. In particular, I investigated into thearguments by strong supporters of judicial review such as RonaldDworkin, Jesse Chopper and John Hart Ely on the one hand, andthose by firm opponents against judicial review like JeremyWaldron, Larry Kramer and Mark Tushnet on the other. In thecourse of the analysis, I tried to make clear both the substanceand limits of the arguments of each group. I found out that defenders of judicial review have failed inexplaining clearly why the unelected and thus undemocraticjudges(courts) should have the authority of judicial review andfurther why the effect of judicial review should be to nullify a lawenacted through a majoritarian process by elected representatives. Those opponents have also been unsuccessful in offering anappropriate remedy for the infringement of fundamental humanrights by the legislation. In short, both arguments seem to beunsatisfactory. Based on this observation, I attempted to grope for somealternative models to solve the problem, such as organizing thecourts by supermajority of the legislature on the one hand, andrestricting the effect of the court decision by granting the decision only a recommendatory effect or allowing the legislative body torepeal the decision by supermajority vote. However, all thesedevices prove to be insufficient to overcome the above-mentioneddifficulties. Then I turned my attention to a seemingly radicalproposal, a constitutional jury, which seemed to be capable ofresolving the related problems. Though it was suggested by a partyand a legal scholar in a very abstract and rough form and thusmight be expected to face lots of theoretical and practical barriersin order to be institutionalized, a concrete and delicate design forinstitutionalization, paradoxically, could make it a fundamental anddemocratic alternative to the existing judicial review system. Performing the task will be left to my future research.
