데이트 폭력 대처방안에 대한 소고- 폭력전과공개제도를 중심으로 -

본 논문은 데이트폭력 관련 현행 법령 및 법제도를 소개한 후, 그 문제점과 그를 극복하기 위해 제시된 다양한 방안 및 입법론, 예를 경범죄처벌법 개정안, 스토킹처벌방지법제정안, 가정폭력방지법 개정안, 데이트폭력처벌특례법 제정안 등에 대해서 그 의의와 한계에 대해서 차례로 검토하였다. 그 중에서도 데이트폭력 예방책으로서 이슈가 되고 있는 영국의 폭력전과공개제도(클레어법)의 국내 도입 여부의 타당성을 검토하기 위해서 영국 클레어법의 주요 내용을 소개한 후, 국내 도입 여부 검토시 고려할 요소들과 선행 조건들에 대해서 필자의 사견을 제시하였다. 폭력전과공개제도의 국내 도입시 그 순기능보다 역기능이 많을 수 있다는 점을 고려하여 신중한 접근이 필요하다는 점과 특히 피해자보호를 위한 다방면의 장치 마련 등 여러 가지 측면에서의 제도적 보완이 전제되어야 함을 피력하였다. 끝으로 향후 클레어법의 국내 도입시 중요하게 고려할 쟁점들(위험성 측정 기관(정보공개결정위원회)의 구성 및 성격, 위험성 측정 요소, 공개 전과 범위 및 공개 방법)에 대해서 필자 나름의 의견을 덧붙였다.
Abstract
The awareness of the extent and nature of dating violence in Korea has increased in recent years as media has kept reporting serious dating violence cases and the relevant investigation has shown its seriousness and need for stronger countermeasures against it. To prevent dating violence and support its victims, several reform bills were proposed in 2017 and are currently pending at the National Assembly. Also the British domestic violence disclosure scheme (‘Clare’s Law’) is in the spot light as an effective prevention measure which enables sharing of information about intimate partner’s prior histories of violence. The first part of this article examines the merits and limitations of those proposed bills ― the Anti-stalking Law, the Anti-dating Violence Act, the Domestic Violence Prevention Act Amendment, and the Minor Offences Act Amendment ― on the perspectives of the effectiveness, the system appropriateness, and the need to balance the right to protection with the right to privacy etc. The second part provides the detailed information on the ‘Clare’s Law’s operation process, related concepts and the institutions. Furthermore, it examines the necessity and validity of its introduction to Korea. Lastly, it suggests the author’s ideas on the initial issues like the process and extent of the sharing information, the organization for the risk assessment and the risk assessment check lists for the further and deeper discussions.
