영국의 가정폭력전과공개제도 도입에 대한 고찰

영국의 가정폭력전과공개제도는 데이트관계에 있어 잠재적 피해자에게 잠재적 가해자의 전과정보를 제공하는 것으로서 데이트범죄를 예방하는 효과적인 수단으로 인정될 수 있다. 우리나라에서도 살인 등 데이트범죄가 문제시 되는바, 가정폭력전과공개제도의 도입을 검토할 만하다. 가정폭력전과공개제도는 헌법과 헌법재판소의 결정으로 정당화 될 수 있고 ‘개인정보보호법'과도 합치하는 면이 있기 때문에 우리 법체계에 도입의 토대가 마련되어 있다고 볼 수 있다. 도입을 위해서는 우선 데이트폭력을 ‘가정폭력범죄의처벌등에관한특례법’의 보호 범위에 두고, 미국 뉴저지주의 판결에 따라 데이트관계를 입증하는 방안을 마련해야 한다. 구체적인 도입논의에 있어서는, ‘알 권리’에 기반한 정보공개는 전과자의 개인정보가 무차별적으로 조회될 우려가 있기 때문에 허용되기 어렵다 할 것이고 ‘문의할 권리'에 기반한 정보요청이 중심에 되어야 할 것이다. 또한 한국형 위험심사단계의 개발, 정보공개 여부를 결정할 기관의 선정, 공개되는 전과정보의 내용과 기간, 전과정보 남용의 책임, 전과자에 대한 통지의 문제도 다루어야 한다. 본 연구는 이러한 사항들에 대한 논의를 내용으로 하며, 향후 축적될 연구성과와 입법안 등을 참고하여 후속연구를 진행한다.
Abstract
Domestic Violence Disclosure Scheme(DVDS) supports disclosure of criminal records of the potential assailant to the potential victim in a dating relationship and can be used as an effective way to prevent date crime. In Korea, date crime including murder has emerged as a problem so it is worth reviewing the possibility of introducing DVDS. DVDS can be justified by the constitution and the decision of Constitutional court of Korea, and it coincide with Personal Information Protection Act in some aspects, so it can be said that Korea’s legal system has the ground to introduce the law. In order to introduce the law, date crime should be put under the legal protection of Act On Special Cases Concerning The Punishment, Etc. Of Crimes Of Domestic Violence, and ways to prove dating relationship should be introduced according to the court decision of New Jersey. As for the specific discussion on introducing the law, information disclosure based on the right to know will be hard to allow as there are concerns that personal information of ex-convicts will be indiscriminately checked, so the request for information based on the right to ask should be the main focus. Also should be handled are issues such as development of Korean-version risk assessment stages, selection of agencies to decide whether to disclose information, the contents and disclosing period of criminal records, the responsibility for the abuse of criminal records, and announcing the ex-convicts. This study discusses these issues and will conduct follow-up studies referring to the research results and legislation bills.
