주민감사청구제도의 실효성 제고를 위한 법리적 재검토

본 논문은 현행 주민감사청구제도의 법리적 측면에서 재검토를 통해 그 실효성을 확보할 수 있는 방안을 모색하고자 했다. 특히 중앙정부 차원에서 시행되고 있는 감사원의 국민감사청구제 및 공익감사청구제가 주민감사청구제와 경합을 벌이고 있는 상황이라고 보아 3개 제도의 구체적인 비교를 통해서 주민감사청구제가 침체될 수밖에 없는 이유를 살펴보고, 그 발전을 위한 재설계방안을 제시하였다. 분석결과를 종합적으로 요약하면 다음과 같다. 첫째, 청구인수 기준이 시도(市道)는 100∼200명선, 시군및자치구(市郡및自治區)는 50명 내외 선에서 결정되는 것이 바람직하다. 비영리민간단체지원법의 요건을 갖춘 건전 시민단체도 청구를 할 수 있도록 명문화할 필요가 있다. 둘째, 행정안전부에 감사청구 전담부서를 설치하여 자치단체의 사무에 대한 주민감사청구를 총괄적으로 조정하여 처리하게 할 필요가 있다. 셋째, 청구대상 사항을 구체적으로 열거하여 감사대상범위를 넓혀주어야 한다. 넷째, 별로 실익이 없는 대표자증명서의 신청 및 발급, 서명요청권 위임제도를 폐지하고, 처음부터 여러 명의 대표자를 선정하여 청구서에 기재, 서명할 수 있게 하여야 한다. 다섯째, 서명자 식별을 위해서는 연락처(전화번호)를 명기해야 한다는 법령규정이 있어야 하고, 주민등록번호 대신 공부상의 생년월일만으로도 충분하다. 여섯째, 청구인 및 이해관계인의 순응확보를 위해서 심의회가 감사활동을 지원하거나 자문하는 정도에서 벗어나 의결대상을 넓히고 그 구속력을 보장받을 수 있도록 법령에 명문화되어야 한다. 일곱째, 사안에 따라 15일 내지 1개월의 집중 감사가 적정한 것으로 사료되며, 감사결과에 대한 조치는 온정주의로부터 벗어나 엄중해야 한다.
Abstract
This article aims at legally-reexamining the (Right of) Citizen's Demand of Local Audit for the increase of its effectiveness at the dimension of local autonomy. But this system especially competes with two other similar systems now taken effect at Board of Audit and Inspection at the dimension of central government, that is, the (Right of) Citizen's Demand of Audit and the (Right of) Citizen's Demand of Audit for Public Interest. So, even local residents are inclined to prefer central-class systems to CDLA. This article analyzes the weakness and stagnation of CDLA through concrete comparison of these conflicting three systems and then suggests the method for the redesign of CDLA. The system of CDLA is necessary to be improved as follows. First, the number of residents needed to demand the local audit is desirable to be set 100 to 200 persons at upper-class local self-governments and about 50 persons at lower-class ones. And also competent Non-Governmental Organizations should be eligible to demand the local audit. Second, the exclusive-charged department for the demand of local audit should be established in the Ministry of Public Administration and Security to generally treat and coordinate the citizen's demand. Third, the coverage of audit-demand object office should be expanded and also be enumerated more specifically. Forth, the procedure of the demand of local audit, for example, with regards to such as a representative of residents and the identification of signatory persons, should be more simplified, and the inquiry commission for the demand of local audit should functionally be more strengthened beyond only supporting and consulting. Lastly, it is appropriate that the period of audit execution is 15 to 30 days intensively according to audit contents. And correcting treatment after audit results should be strict severely and be impartial without private intervention.
