공론화의 조건과 제약요인: 사용후핵연료 관리정책 재검토위원회 참여경험을 중심으로

본 연구는 사용후핵연료 관리정책 재검토위원회 사례를 대상으로 공론화의 조건(기본원칙)과 제약요인을 분석하였다. 사례분석 결과, 공론화의 조건에서 주관기구(실행기구)의 독립성과 중립성 결여, 참여자의 대표성과 포괄성 부족, 운영과정의 공정성·투명성·숙의성 미흡, 공론화 결과의 성찰성과 수용성 저하 등 전반적으로 기본원칙이 지켜지지 못한 것으로 나타났다. 재검토위원회 사례가 이처럼 부정적인 평가를 받게 된 근본적인 원인은 공론화를 둘러싼 제약요인(정치사회적 요인, 환경적 요인, 내적 요인)을 극복하지 못했기 때문이었다. 따라서 향후 이 같은 전철을 되풀이하지 않기 위해서는 몇 가지 제도적 개선방안이 필요하다. 첫째, 사례분석에서 밝혀진 공론화의 제약요인을 극복하기 위해서는 주관기구의 독립성과 중립성 확보가 선결과제라고 할 수 있다. 사용후핵연료 문제에 대한 해법을 찾기 위해 박근혜·문재인 정부에서 두 차례나 공론화를 실시했지만 오히려 갈등만 증폭시킨 가장 큰 이유는 산업부 산하에 설치된 공론화위원회의 독립성과 중립성 문제로 사회적 수용성을 확보하지 못하였기 때문이었다. 둘째, 공론화가 성공하기 위해서는 참여자의 대표성과 포괄성이 확보되어야 한다. 공론화를 통해 정책의 정당성을 확보하고 사회적 합의를 도출해 공공갈등을 해결할 수 있기 위해서는 공론화 과정에 다양한 이해관계자들의 포괄적인 참여가 전제되어야 한다. 셋째, 한국형 공론조사(deliberative polling) 모델로 회자되는 ‘시민참여형조사’의 한계를 보완하고 숙의를 위한 새로운 공론화 기법의 개발 및 활용이 필요하다. 넷째, 공론화가 ‘작은 공중’(mini-publics)이라는 좁은 범위를 벗어나 일반국민들과의 소통을 통해 사회적 공감대를 형성하기 위해서는 다양한 홍보 및 소통방안이 필요하다.
Abstract
This study provides conditions and constraint factors of the public deliberation using the case of the reexamination committee on the "Spent Nuclear Fuel" policy. The result shows that the reexamination committee fails to secure the legitimacy of the policy because the basic principles are not fully guaranteed throughout the process. In addition, it fails to overcome the constraints of public deliberation, including political and social factors, environmental factors, and internal factors. Therefore, a few institutional improvements are needed not to meet the same fate as the reexamination committee. First, it is a prerequisite to secure the independence and neutrality of the governing body. Second, the comprehensive participation of various stakeholders is required throughout public deliberation. Third, it is necessary to develop and use a new public deliberation technique to overcome the limitations of the current deliberative-polling in Korea. Lastly, various communication methods are needed to form a social consensus through communication with the general public.
