Abstract
The Japanese Government is of the view that the San Francisco Peace Treaty restored Japan to “full sovereignty” and that it laid the foundation for peace and prosperity in the Asia Pacific. By virtue of the Treaty, all the post-war settlement issues were said to be resolved. Behind this perception is a classic understanding of international law aimed at safeguarding state interests. Embedded in the Treaty were state-centrism and colonialism, two of the distinctive features of traditional international law, in which ‘peace’ was perceived to be an absence of war between sovereign states. 70 years since then, normative environments in international society have fundamentally changed and the concept of peace is now redefined so as to include protection of human rights. In contemporary international legal discourse, it is human dignity, not state interests, that is given the highest priority. Deconstructing the San Francisco Peace Treaty and the 1965 Claims Agreement between South Korea and Japan, this essay argues that the relevant treaties have to be interpreted and applied within the framework of the contemporary prevailing legal system. It is untenable under the prevailing normative circumstances that the Treaty and the 1965 Agreement are mobilized to block the restoration of human dignity of survivors/victims of Japan’s colonial wrongs. It is time that East Asia, Japan in particular, should squarely face the colonial past and join a dynamic global movement for undoing historical injustices by invigorating ‘peace’ in the San Francisco Peace Treaty.
