Abstract
The problem of the legitimacy of state power has become more and more central political issue in modern democratic society because the relation between individuals and state is tend to be in a certain tension. there is some limitation of individual life from state power. Of course, this political power is defined by constitutional law which is based on citizens' rights and happiness. However, it is easy to meet unfair political situation that state power violates individual rights. If the state power is just for a certain classes and politicians, it would make serious social conflict and fragmentation. Today, we can't make sure that we are not in this kind of social and political situation. Perhaps, we might be situated in democratic political system which does not respect individual rights more fairly. Many are suspicious about the way which state power is carried by the politic and the law. In this paper, I will look at the tradition of social contract theories of Hobbes and Locke. Then, we will examine the conception of the legitimacy of state power in the contractual tradition. Hobbes want to show how cooperative civil society can develop and exist amongst human beings in 'the state of nature' His political theory has been valued as a typical political theory which made the foundation of modern democracy because he think that individual rights is most important and crucial factor that state power should consider for its exercise. Similarly, Locke also insists that it is impossible for government to give a certain political duty to the citizens without their consent. For Locke, political power should be a certain power for public good and promotion of citizens' life. I argue that we will be able to reflect and consider about our political situation with the legitimacy of state power throughout their contractarian view. So I am trying to deliberate about the genuine political power in our political society with this work.
