키케로의 국가론과 자연법사상에 관한 고찰

이 연구의 목적은 로마 공화정 말기에 활동했던 대표적인 사상가이자 정치가인 키케로의 공화주의 국가론 및 그와 밀접히 연관된 법의 지배 이념을 고찰하는 것이다. 키케로 국가철학의 근본특징은, 그가 국가를 인민의 이익공동체인 동시에 법적 동의에 의한 집단으로 규정한 점에 있다. 국가 구성원인 인민은 자연인과 구분되는 바, 전자는 법이 보장하는 동등한 권리를 지니고 있으며 또한 구속력 있는 합의를 바탕으로 상호 간에 공동의 이익을 추구하는 주체이다. 다른 한 편, 공화주의 사상가 키케로는 국가의 성립이유 및 목적과 관련해서 국가가 공적 성격을 띠고 있는 집단임을 강조하였다. 인간이 국가와 사회를 구성하게 된 이유는 흔히 근대 계약론자들이 생각하듯 단순히 생존경쟁에서 살아남기 위함이 아니며, 오히려 공동체의 틀 안에서 자아를 실현하고 나아가 공동체 자체를 유지하고 발전시키려는 보다 근원적인 욕구가 우리 인간 안에 내재해 있기 때문이다. 그는 전통적인 단순정체를 넘어서는 한편 기하학적(비례적) 평등 관념에 입각한 혼합정이 바람직하다고 보았는데, 그가 구상한 혼합정은 각 분야별로 가장 탁월한 개인(정무관의 집행권 imperium), 귀족(원로원의 정책적 조언 consilium), 인민(민회를 통한 자유 libertas)에 의한 국정 참여가 보장되고 상호간 견제와 균형을 통해 조화에 도달하는 상태를 의미한다. 키케로 법철학의 특징은 그가 스토아 자연법사상의 핵심내용을 수용하여, 진정한 법은 자연에서 유래하는 올바른 이성과 일치하고 보편적으로 적용될 수 있으며, 따라서 자체로서 정의로운 자연법임을 주장하였다는 점이다. 나아가 그는 자연법을 ‘신법’이자 ‘이성의 법’이자 ‘정의의 법’이라고도 표현하며, 모든 실정법은 이 신성하고 영원한 자연법에 토대를 두어야 함을 강조하였다. 또한 인간은 자신의 이성을 통해 ‘우주세계의 보편적 이성’, 즉 ‘자연’의 본성을 인식하며, 이를 ‘신’과 공유함으로써 신들과 ‘우주적 차원의 공동체’를 형성할 수 있다. 키케로는 법은 원칙적으로 덕에 부합하는 행위를 장려하고 악행을 억제하며, 나아가 국가 안에서 인민들이 이 덕을 기반으로 자유롭고 행복한 삶을 살 수 있도록 인도한다고 주장하였다.
Abstract
The aim of this article is to study Cicero’s political and legal philosophy. The philosophy of Cicero had a political purpose: the defense and improvement of the Roman Republic. The politicians of his time were corrupt and no longer possessed the virtuous character. The loss of virtue was the cause of the Republic’s difficulties. Cicero tried to use philosophy to bring about his political goals. Cicero's most important political work is "On the Republic". This book describes the ideal commonwealth. It tries to provide philosophical underpinnings for existing Roman institutions. Cicero describes the importance of an active life of virtue, the foundations of community, including the community of all human beings, the role of the statesman, and the concept of natural law. Cicero's "On the Laws" is also his famous philosophical and legal text. In it Cicero lays out the laws that would be followed in the ideal commonwealth described in On the Republic. Any valid law is rooted in nature, and any law not rooted in nature is no law at all. The gods also share in reason, and because of this they can be said to be part of a community with humanity. They care for us, and punish and reward us as appropriate.
