Abstract

The parties may, with an arbitration agreement, choose arbitration instead of litigation for the dispute resolution. On the other hand, the state retains the power to reserve settlement of certain types of dispute for its courts. Therefore, it is necessary to delimitate between arbitrable and non-arbitrable dispute, which allocates authority between arbitrators and courts. Although arbitration is considered to be a fast and efficient alternative dispute resolution mechanism, questions regarding whether a claim or dispute in question is legally capable of being arbitrated can undermine good faith efforts by the parties to resolve the dispute efficiently. Despite a substantial maturation of the arbitrability doctrine, uncertainty surrounding it has not been improved. The expansive application of the non- arbitrability doctrine contracts the vital goal of an arbitration agreement by the parties to resolve their dispute efficiently without intervention of courts. Courts’ excessive intervention based upon non-arbitrability could undermine arbitration itself which is generally considered an efficient method of resolving disputes. The allocation of jurisdiction between arbitrators and courts could be reasonably achieved by addressing arbitrability based on balancing legitimacy and efficacy in arbitration. Clear delimitation of arbitrability and narrowly-tailored non-arbitrability doctrine could promote the development of international trade by vitalizing international arbitration. The existence of the types of non-arbitrable disputes involving public interest or interests of third parties cannot be denied, and the interests protected by the law applicable to arbitrability should be respected. However, non-arbitrability exceptions should, in light of the New York Convention’s basic objectives and structure, be granted only when narrowly tailored to achieve articulated public policies. It remains to be seen whether the arbitrability doctrine is a transnational principle directly applicable without reference to national law. It would be unrealistic to interpret arbitrability on an internationally uniform basis in the foreseeable future. On the other hand national legislatures and courts must be within the internationally acceptable limits instead of applying unilateral rules when establishing the non-arbitrability doctrine. In addition efforts should be made in harmonizing decisions for arbitrability across different stages in the arbitral process. This research could contribute to reducing uncertainty lingering in the arbitrability doctrine with internationally harmonious interpretation by reasonably delimiting the scope of arbitrability questions which can arise at different stages in the arbitral process and before different fora: the tribunal or court.
