해상화물운송장에 대한 개정상법 규정의 재검토

고속선의 발달과 선하증권의 위기에 대한 근본적 해결책으로 해상화물운송장이 거론되어 왔다. 이에 2007년의 상법 개정으로 인하여 상법 제5편에 해상화물운송장에 관한 규정이 입법화되었다. 그러나 해상화물운송장이 국제운송에서 주로 이용된다는 점에서 보면 국제적으로 널리 인정되는 통일법규의 미비 또는 통일된 법리의 미비로 인하여 기존의 문제점이 여전히 존재한다고 보아야 한다. 이에 해상화물운송장에 관한 국제규범, 외국 법률의 내용을 검토한 후, 개정상법에서 신설된 해상화물운송장에 관한 규정을 분석하고 개선방안을 찾고자 한다.
Abstract
The Sea Waybill has been suggested as a fundamental solution to the problems high-speed ships and Bills of Lading. The Sea Waybill was regulated in Charter Ⅴ of the Commercial Law by an amendment of Commercial Law. But to the point of using the Sea Waybill in international transportation, the problems of the absence of a unified regulation and doctrine has existed. Following my studies of international regulations and laws of foreign countries, this paper seeks legislative improvement though the analysis of the problems of the new articles regulating the Sea Wabill in Commercial Code which was amended in 2007.
