본 연구에서는 일본의 사회복지에 있어 장애인 자립 패러다임의 변천을 알아보기 위해 「장애인자립지원법」의 제정 시기(2006)를 기준으로 살펴보았다. 먼저 전후 50년 넘게 일본 장애인 시책의 주류를 이룬 것은 조치비제도였다. 조치비제도 하에서 장애인의 복지 서비스 이용은 관료적인 행정 조치의 일환으로서 이루어졌다. 이 경우 장애인 당사자의 자기결정권은 인정될 수 없었으며, 장애인에게 요구된 것은 재활 패러다임에 근거한 개인적 차원에서의 장애의 극복이었다. 조치비제도에 이은 지원비제도(2003)에서는 장애 당사자와 서비스 공급자간의 자유로운 계약에 의한 자립생활 패러다임으로의 전환이 이루어지면서도 그에 따른 재원이 확보되지 못함으로써 결국 형해화한다. 지원비제도가 폐지된 후, 장애인자립지원법이 제정(2006)되는데 이 법률에서는 특히 장애인의 응능부담제를 채택하여 장애인의 자립을 경제적 자립에 한정시킴으로써 장애인의 자립생활 패러다임은 다시 후퇴하게끔 되었다. 이같은 일본 장애인 자립 패러다임의 변천을 고찰함으로써 우리가 얻을 수 있는 시사점으로, 공정성 지향의 사회변화를 바탕으로 한 장애인 자립 패러다임으로의 시급한 전환이 장애인복지 시책의 대전제가 되어야 한다는 것이다.
Abstract
The Shift of Independent Living Paradigm of People with Disabilities at Social Welfare in Japan Cho, Won-Il(Kyonggi University)This study examined the changes of the independent-living paradigm among persons with disabilities based on "Law of Assisting the Independence for the Persons with Disabilities" of 2006 in Japan. Before the establishment of the law, the major policy for the persons with disabilities was leaded by Sochihiseido(as a type of administerial order). Under the Sochihiseido, the self-determination right was not allowed when the persons with disabilities chose and utilized the social services. Given this situation, persons with disabilities was requested to overcome disabilities. Siennhiseido(support system according to contract with between welfare service supplier and user) of 2003 followed the Sochihiseido. Siennhiseido suggested the independent living paradigm, in which the persons with disabilities were allowed to make the free contract with service providers. However, it was disappeared because of the lack of financial supports. After the abolition of the Sochihiseido, the "Law of Assisting the Independence for the Persons with Disabilities" was established in 2006. The major idea of this new law was to adopt the Oekihutannseido(payment system according to profit) and reduce the meaning of the independence to the economic independence. This led the independent living paradigm to be receded. The lessons from the paradigm changes of Japan are that the policy for the persons with disabilities should made an immediate change to the independent-living paradigm based on the social change toward fairness.
