본 글의 목적은 첫째, 정책패러다임에 관해 이론적으로 고찰함으로써 정책패러다임의 내용과 특징을 살펴보고 정책변화를 설명하는 데 있어서 정책패러다임의 유의성을 밝히는 것이다. 이익의 극대화를 추구하는 행위자의 합리적 선택과 선행 제도의 제약을 강조하는 이론들은 점진적인 정책변화를 설명하고 있어, 선행 제도의 경로에서 이탈하여 새로운 제도의 경로가 형성되는 급진적인 변화를 설명하는 데에는 한계가 있다. 이에 대해 ‘아이디어의 요소, 문제의 인식구조, 정책목표와 그를 달성하는 도구, 정치적 담론에 관한’ 해석 틀인 정책패러다임은 이러한 해석 틀의 변화로 정책변화를 파악하며 기존의 패러다임에서 새로운 패러다임으로의 급진적인 변화를 설명한다. 정책패러다임의 변화 요인은 기존의 정책패러다임 하에서 새롭게 대두된 문제를 해결하기 위해 도입된 정책실험의 실패와 외부압력이다. 본 글의 두 번째 목적은 정책패러다임 이론을 여성정책에 적용하여 ‘보호’, ‘평등’, ‘젠더평등’의 3가지 여성정책 패러다임을 제시하고, 이를 바탕으로 전후 점령기부터 현재에 이르는 일본여성정책의 변화를 통시적으로 파악하는 것이다. 최근에 여성정책의 변화를 패러다임적 변화로 파악하는 연구가 진행되고 있으나 여성정책의 패러다임이 무엇인지, 여성정책의 변화를 왜 패러다임적 변화로 파악하는지에 대해서는 설명하지 않고 있다. 분석 결과, 일본의 여성정책은 보호패러다임에서 젠더평등패러다임으로 결정적으로 변화했음이 밝혀졌다. 일본에서는 평등패러다임은 정착하지 못했다. 보호패러다임에서 젠더평등패러다임으로 변화한 요인으로는 외부적으로는 유엔에 의한 압력이 작용했다. 내부적으로는 첫째, 보호패러다임 하에서 도입된 남녀고용기회균등법의 정책실패, 둘째 자민당 일당우위체제의 변화, 셋째 정책엘리트 간의 권력관계의 변화가 작용했다. 정책패러다임을 제도화하고 담론화 하는 주체가 노동단체에서 여성문제전문가와 젠더연구자로 변화한 것이다.
Abstract
To understand how Japanese policy on women has changed over time, this paper takes mainly the case of Labor Standards Law, the Equal Employment Opportunity Law and the Enactment of Gender Equality Fundamental Law for analysis. The analytical framework of the study is based on the concept of policy paradigm by Peter Hall. Policy paradigms refer to the set of ideas and standards that specify the goals of policy, the kind of instruments that can be used to attain them, and the nature of problems they are meant to address. This paper focused on policy ideas on equality of men and women- ‘protection’, ‘equality’, and ‘gender equality’- how they flowed into political process and clashed with each other and became institutionalized. Through the analysis, a change process in Japanese policy on women has been found which shifts from ‘protection paradigm’ to ‘gender equality paradigm’
