Abstract
The purpose of this article is to examine the possibility that the United States would recognize a new trial against the interests of defendants as a major exception to the rule against dual jeopardy, as the United Kingdom has changed to allow such a new trial. In light of the introduction and development history of the rule against dual jeopardy in the United States, unlike the case of the United Kingdom, it is considered that the possibility of allowing the new trial against the interests of defendants is relatively small in the United States. It is because allowing a new trial against the interests of defendants constitutes a grave exception to the rule against dual jeopardy, in that such rule in the United States has been developed to expand its coverage since it was introduced from the common law of the United Kingdom. The fact that the coverage of the rule against dual jeopardy has been expanded in the United States can be explained through the following facts. First, while the Double Jeopardy Clause of the 5th Amendment to the U.S. Constitution was originally applied only to the federal government, the clause has also applied to the states through the Due Process Clause of the 14th Amendment since the Supreme Court's Benton v. Maryland decision. Second, because the application of the rule against dual jeopardy in the United States is not premised on the existence of a final judgment, the rule starts to be applied at the very early stage. Third, the United States' rule against dual jeopardy prohibits successive prosecutions for those who have already been acquitted or convicted for the same offense, as well as multiple punishments for the same offense in a single procedure. Finally, the cases in which the rule against double jeopardy could be applied have been expanded by devising mechanisms that supplement the 'same-element test' on the grounds that in the case of successive prosecutions, unlike the case of multiple punishments, the defendants' interests to be protected through the rule against dual jeopardy are much more serious. As a result, it seems that there is little room in the United States to allow a new trial against the interests of defendants that would constitute a grave exception to the rule against double jeopardy.
