본 논문의 목적은 일본, 독일 헌법에 있어서의 인권과 기본권의 개념을 개념사의 관점에서 고찰을 하고, 이를 토대로 우리나라 헌법의 기본적 원리인 인권과 기본권에 대한 개념적 정의를 내리려는 것이다. 우리나라 헌법 전체를 관통하고 있는 여러 원리 중에서 가장 기초적인 원리의 하나가 기본적 인권 존중이라는 것에 이론이 없을 것이다. 그러나 기본적 인권이라는 말이 어떤 내용을 포함하는 개념인가, 기본적이라는 것은 어떠한 의미인가, 따라서 인권과 기본권은 어떤 관계에 있는 것인가에 대해서는 그다지 명백하지 않으며, 의식적으로 또는 무의식적으로 이러한 말을 구별 없이 사용하는 경우가 많다. 1960년대 이후 소위 새로운 인권이 등장하여, 한편으로는 이것들의 헌법적 위치지움의 문제와 함께 종래의 인권 체계의 재구성에 대한 시도도 이루어지고 있었으나, 다른 한편으로는 이러한 인권 개념의 확대 현상은 오히려 인권의 본래 의미를 애매하게 할 위험성도 있다. 이에 본 연구는 인권, 기본권, 기본적 인권 등의 개념에 대해 논구할 가치가 있는 것은 아닌가라는 문제의식에서 출발하여, 특히 독일과 일본의 헌법상의 대응 개념과 비교법적 관점에서 이러한 용어의 관계에 관하여 예비적 검토를 시도하는 것이다. 이를 위해 우리나라 헌법의 제정과 개정과정에서의 인권과 기본권 개념의 해석과 변천과정을 문제 개념사 관점에서 고찰하려고 한다. 우선 법이론에 있어서의 기본적 인권과 인권 개념 등을 역사적으로 검토한다. 그리고 독일 헌법에서의 인권과 기본권의 개념에 대해 고찰하고, 이를 수용한 일본 헌법의 인권과 기본권에 대한 개념적 고찰을 한 다음, 이를 토대로 우리나라 헌법에서의 인권과 기본권에 대한 개념적 정의를 시도한다.
Abstract
The purpose of this paper is to make a conceptual definition of the human rights and fundamental rights as one of the basic principles of our constitution through reviewing the concepts of human rights and fundamental rights in the Constitution of Korea, Japan and Germany. It would be indisputable that human rights is one of the most basic principles that penetrates into the Korean constitution. However, it is not clear concept as to what basic human rights contain, what it means to be fundamental, and what basic rights are related to human rights, they are often used without distinction consciously or unconsciously. Since the 1960s, so-called new human rights have emerged, while attempts have been made to reorganize the existing human rights system along with the question of their position within constitutional structure, on the other hand, the expansion of the human rights concept causes a risk of obscuring the original meaning of human rights. Therefore this study starts from the question of whether it is worth arguing about the concepts of human rights, fundamental rights, basic human rights, and develops a preliminary review of the relationship of these terms, especially from the perspective of the comparative law within the context of German and Japanese Constitutions. In this article, I mainly examine the interpretation and revision of the concepts of human rights and basic rights in the process of enacting and revising the Korean Constitution historically and comparatively. First of all, I consider accepting the concept of God-given nature rights of man, human rights and fundamental rights in modern legal theory. After examining the concepts of human rights and basic rights in the German Constitution and Japanese Constitution as its successor I try to define human rights and fundamental rights on this base.
