개인정보보호법의 GDPR 및 4차 산업혁명에 대한 대응방안 연구

Abstract

With the enactment of the "GDPR" (EU) 2016/679) in May 2018, each member of the EU is making various efforts to prepare for the implementation of the "GDPR" by revising the Personal Information Protection Law of each country and revising guidelines for the protection of personal information that will be applied uniformly within the EU. In particular, in response to the legislation of the GDPR, it is clear that each Member State already has provisions for personal information protection that are quite close to the GDPR through its own legislation or existing legislation. The improvement of EU's privacy law and its relationship with the Fourth Industrial Revolution in accordance with the enforcement of the GDPR has important implications for the future legislation and policies in the context of Personal Information Protection in Korea. A comparative analysis of laws and policies related to personal information protection in Germany, Britain and France, following the introduction of the GDPR, could give a good indication of the country's response to the law and the direction of improvement of the legislation. In general, with the advent of the Fourth Industrial Revolution, most industries will be virtually dependent on big data. In such cases, the use and abuse of personal information is inevitable. What is important in this situation is how well it protects the rights of the informant in the long run to prevent the harm of the abuse. In terms of legal system, the need to further consolidate the character of Korea's Personal Information Protection Law as a general law is derived. It is also emphasized that there is a need to promote the substance of personal information protection through strong enforcement of sanctions by authorities. A complementary tasks to the regulations concerning personal information transfers abroad is also required. .
