법학교육 사례방법의 발달과 주요 특징: 교사교육에 주는 시사점 탐색

초록

법학교육은 판례를 중심으로 한 사례방법을 통해 법이론과 원칙을 교육하고 학생들이 법적 판단과 문제해결 능력, 법적 마인드를 개발하는 데 초점을 두고 있다. 이러한 법학교육의 목적과 교육방법은 교사교육이 지향해야 할 방향을잘 보여준다. 이에 따라 본 연구는 법학교육 사례방법의 발달 배경과 주요 특징을 분석하고 교사교육에 주는 시사점을탐색하고자 한다. 이를 위해 국내외 문헌과 미국 주요 대학의 홈페이지 자료를 수집·분석하는 문헌분석법을 주요연구 방법으로 활용하였다. 분석 결과, 첫째, 미국 법학교육에서 사례방법은 19세기에 처음 도입되었으며, 이는 법이론교육을 중심으로 한 법학교육에 적합한 교육방법으로 현재까지 널리 활용되고 있다. 둘째, 법학교육에서 사례방법은법원의 주요 판례를 중심으로 소크라테스식 문답법으로 운영되었으며, 이러한 초기 사례방법은 집단 토론, 문제해결을강조하는 사례연구방법으로 발전하였다. 셋째, 사례방법은 전문가가 다루는 실제 업무와 밀접한 연관성을 가지고있으며, 수업에서 학생 참여, 토론이 활발하게 이루어진다는 점, 다양한 관점 수용, 비판적 사고 및 문제해결 능력개발에 기여한다는 점에서 강점이 있다. 반면, 사례의 주제와 범위가 한정되어 있고, 학생과 교수 모두에게 부담이크고, 수업 준비가 부족할 경우 비효과적일 수 있으며, 사례방법을 통해 개발 가능한 능력, 기술이 한정적이라는점에서 한계가 있다. 이러한 분석 결과를 토대로 교사교육의 목적 명료화와 공유, 교사교육에서 이론(교육)과 실제(교육)의관계, 교사교육의 성격에 맞는 고유한 사례방법론 개발 등을 주요 시사점으로 도출하고 논의하였다.

Abstract

Legal education focuses on teaching legal theories and principles through case methods centered on legal cases, with the aim of developing students legal reasoning, problem-solving skills, and legal minds. The objectives and methods of legal education provide direction for teacher education. Against this background, this study explores the implications of the case method, developed in legal education, for teacher education by analyzing its background and key characteristics. The primary research method was literature analysis. The key findings are as follows. First, the case method in American legal education was first introduced in the 19th century. It remains the most common educational method to date and is suitable for legal education centered on legal theory. Second, in legal education, the case method uses the Socratic method, centered on major court cases. It has evolved into a case study method that emphasizes group discussions and problem-solving. Third, the strengths of the case method include its close connection to professional tasks, active student participation and communication, and its contribution to the development of critical thinking, acceptance of diverse perspectives, and problem-solving abilities. However, the case method also has limitations, such as restricted topics and scope, significant burden on students and professors, potential ineffectiveness with inadequate preparation, and a limited range of skills and abilities that can be developed. Based on these findings, this paper discusses several key implications for teacher education: clarifying and sharing the objectives of teacher education, examining the relationship between theory and practice in teacher education, and identifying tasks for developing a unique case methodology for teacher education.
