Abstract

Recognition of right to view and concerns on its protection as requirement to live in comfortable environment have been increased according to qualitative improvement of standard of economic and cultural life in Korea. While right to view has been considered as 'reflective or living profit' unlike right to sunshine and recognized as additional rights of right to sunshine, recently supreme court of Korea tends to recognize right to sunshine as a subject of independent legal protection. As right to view has been emphasized, disputes about right to view have been also increased because new construction of residential-commercial complex building and rebuilding work at big cities are increasing. Nevertheless, concrete discussion about scope of legal protection of right to view has not conducted. Therefore, this study is to seek method to ensure efficacy of legal protection of right to view by establishing legal principles of right to view.
