Abstract
Though the matter of view is regarded as important in conjunction with preserving a clean environment, practically the right to a prospect and scenery is not treated as much seriously as the right to enjoy sunshine. However, the position in addressing the trespass on the right to a prospect and scenery as a secondary issue accompanying the right to enjoy sunshine is not agreeable, both rights to a prospect, scenery and to enjoy sunshine should be dealt with equally in terma of the environmental right guaranteed under the constitutional law. Therefore, if the trespass on the right to a prospect and scenery exceeds the endurance limit, a judicial remedy for the right to a prospect and scenery itself schould be admitted regardless of the condition that the trespass on other environmental rights such as the right to enjoy sunshine exceed their acceptable limits or not. In this regard, the usefulness of endurance limit is still acknowledgeable as a standard of judgement for the trespass on the right of a prospect and scenery, it is expective that the applicability of possitive and progressive theory based on the environmental right to the related practical trials can be seriously examined in the future.
