최근 환경 분야의 가장 큰 현안 중 하나인 미세먼지 문제는 보건에 미치는 심각한 영향에 비하여 두드러진 개선이 이루어지지 않고 있다. 미세먼지를 포함한 모든 환경문제는 문제 자체에 대한 분석이 있어야 효율적 해결책도 제시될 수 있다는 점에서 본 연구는 환경법적 관점에서 단순히 미세먼지에 대한 전반적인 법제도를 살펴보는 대신 미세먼지 문제 분석 후 이에 근거하여 올바른 대응책을 위한 선행과제는 무엇인지 다루고 있다. 본 연구는 선행과제로서 첫째, 해결 대상인 미세먼지의 개념 자체가 환경법제에서 명확히 규정되어 규제되고 있는지, 둘째, 문제해결의 시작인 미세먼지 측정이 정확히 되고 있는지 검토한다. 이러한 검토 후 본 연구는 첫째, 미세먼지 측정 자체가 현재 과학기술 상 어렵다는 점에서 미세먼지 정책은 미세먼지 측정기술에 대한 R&D에 우선 순위를 두어야 하며, 둘째, 미세먼지를 대기환경보전법에서 대기오염물질로 독립하여 규정하고 그 배출허용기준 역시 명확히 설정하며, 셋째, 현행 배출허용기준 검토에 근거하여 노후 화력발전소와 경유차에 대한 집중적 관리를 제안하고 있다.
Abstract
Problems of PM-2.5 which is carcinogenic to humans became a one of the most public concerns in Korea. This short paper begins with questioning of why current legal system cannot reduce the PM-2.5 problems and raised issue of its possibility of wrong approach to handle the problems such as its measurements and legal definition for appropriate regulation in current environmental laws. This paper provides following thoughts; firstly, it is necessary to put priority on R&D for the measurement technology of PM-2.5 which is a basic step to solve the problem. Secondly, even though Environmental Policy Basic Act sets the environmental standards for PM-2.5, its implementing acts including Ambient Preservation Act does not only provide specific legal definitions and its discharging permissible standards but also clarify its definition with dust, particles and smoke; therefore, it is necessary to have a clear definition and implementing measures of PM-2.5. Finally, because two third of total PM-2.5 are the secondary PM-2.5, the emission criteria of precursor of PM-2.5 such as SOx and NOx should be more strictly regulated. It is also necessary to have a precise inventory of Pm-2.5 sources and volume of emission and focus on the main target based on the inventory; moreover, post-management of the emission criteria is also important. It should be considered to close the old coal power plants and to reduce the running rate of diesel engine power plants in the national energy plans. Emission testing of diesel engine automobile should check the NOx like gasoline and gas engine automobile emission testing. Emission testing of diesel engine automobile which are implemented in only metropolitan area should be implemented in national-wide.
