국회 상임위 전문위원의 입법 영향력을 어떻게 민주적으로 통제할 것인가? 입법 지원조직 스태프에 대한 민주적 책임성 확보 방식 비교 연구

한국 국회는 상임위 중심주의의 원칙을 취하고 있고, 상임위는 국회 입법 과정의 핵심이 되는 중요한 조직이다. 그런데 의원은 현실적으로 상임위에서 처리되는 모든 법안을 일일이 검토할 수 없고, 이에 따라 의원은 결국 상임위 내 전문위원이 제출한 사전검토보고서에 의존하여 판단을 내리게 된다. 이렇게 전문위원의 정치적 영향력이 상당함에도 불구하고, 이들은 직업공무원이기 때문에 이들에 대한 민주적 통제 방안은 부재한 상태이다. 이에 본 연구는 미국, 영국, 독일, 일본 등 해외 주요국의 상임위 입법 지원조직 사례들을 비교함으로써, 국회 상임위 전문위원의 전문성과 민주적 책임성을 강화할 수 있는 정치적 방안을 모색한다.
Abstract
The standing committee is a very important legislative organization in the Korean National Assembly (KNA) because it has de facto gatekeeper power in the legislative process. However, members of the committees cannot closely review all bills, so they have no choice but to make a judgment based on preliminary review reports submitted by the deputy chiefs of staff in the committees. Accordingly, the political influence of the staff in the KNA have become considerable, but democratic control over them is very hard as they are unelected public officials of the bureaucratic system. Therefore, this study aims to find political ways to strengthen the expertise and democratic responsibility of the standing committee staff by comparing the cases of legislative support organizations in major foreign countries such as the US, UK, Germany, and Japan.
