다중흐름모형과 정책옹호연합모형 적용을 통한 환경오염피해구제법 도입과정 분석

초록

「환경오염피해 배상책임 및 구제에 관한 법률」은 인과관계 추정, 정보청구권, 환경책임보험, 공적 부조로서 구제급여 지급 등 흥미로운 내용을 담고 있다. 이러한 내용과 함께법률 도입과정 역시 정책학적 함의를 지닌다. 사회적 충격을 가져온 2012년 ㈜휴브글로벌 불산누출 사고는 다중흐름모형에 따른 ‘정책의 창’을 여는 초점사건으로 작용했고, 정부는 환경오염피해구제법 입법을 국정과제로서 추진하였다. 법안 심의과정에서 정책적지향점이 다른 참여자들은 정책옹호연합을 형성하여 인과관계 추정 조항 등을 둘러싼 공방과 타협을 거치며 환경오염피해구제법이 제정되었다. 다중흐름모형 및 정책옹호연합모형은 환경오염피해구제법 도입과정을 설명할 수 있으며, 앞으로 여러 환경법 제･개정에서도 비슷한 모습을 관찰할 수 있을 것이다.

Abstract

The Environmental Damages Liability and Relief Act(here after EDLR) holdssignificant contents, such as the presumption of causation, the right to requestrelevant information, mandatory EIL insurance, and governmental relief measures. Along with these features, the process of legislation is worthy of note in regardsto policy formation. In September 2012, slightly before the presidential election,hydroflouric acid leakage accident took place in Kumi. After this tragic accident,the policy window opened, and the presidential advisory committee made thelegislation of EDLR its top priority. This could be explained with the Multiple StreamsFramework. The focus event prompted the convergence of separate policy streamsto produce a policy. The legislation took two years, and in the meanwhile, interestgroups struggled to maximize their influences on the Bill. They formed policy advocacycoalitions, and the Bill slowly took its shape through the confrontation. Especiallythe Article of the Presumption of Causation was the battle ground of the concerned. The more detailed the account goes, the higher appreciation the MSF and ACF theorycould possess. And this approach would explain other environmental legislation.
