Kingdon의 다중흐름모형을 적용한 「전기용품 및 생활용품 안전관리법」 변동과정 분석

최근 가습기살균제 사건 등 생활용품의 검증되지 않은 유해성으로 인한 소비자 안전문제로 관련 제품 및 시설관리를 강화하려는 정부의 움직임에 따라 「전기용품안전 관리법」과 「품질경영 및 공산품 안전관리법」이 통합되었다. 본 연구는 「전기용품 및 생활용품 안전관리법(이하 ‘전안법’)」의 통합과정을 Kingdon의 다중흐름모형 관점에서 분석하고 정책변동의 과정에서 어떤 흐름이 정책의제설정을 이끄는지를 살펴보았다. 이를 위해 ‘전안법’의 변동과정을 입법단계, 논란 및 재개정단계로 구분하여 시간순에 따라 관련 문헌조사를 통해 문제･정치･정책대안의 흐름을 분석하였다. 분석결과 최초 입법단계에서는 가습기살균제 파동 등 대형 사고들이 문제의 흐름을 주도했고, 관련 부처들의 규제강화 움직임에 따라 정책의 창이 빠르게 열렸다. 초창기 법안은 입법 주도세력의 임기종료로 개정이 급박하게 이루어졌고, 이로 인해 관련 이해관계자들의 의견수렴 과정이 배제되었다. 법률 시행 전 이해관계자들의 집단이 형성되며 강한 반발이 새로운 문제의 흐름을 주도했고, 새로운 입법 세력이 정치의 흐름을 이끌며 공청회, 토론회 등 다양한 의견수렴과정을 통해 개정안을 마련하였다. 두 차례에 걸쳐 정책의 창이 연속적으로 열리는 정책변동과정을 볼 수 있었으며, 그 과정속에서 주도적인 변화를 이끄는 흐름이 서로 달랐다. 본 연구를 통하여 정책의제설정을 위해서는 이해관계자들의 의견을 충분히 수용할 필요가 있으며, 특히 기술규제는 사회적 수용성을 높이기 위한 검토가 선행되어야 함을 알 수 있었다.
Abstract
Recently, there have been many safety problems caused by the harmful effects of household goods that have not been verified like humidifier disinfectants. The government has integrated the two laws to strengthen safety management of household goods. The “Electrical Appliances Safety Control Act” and “Enforcement Degree of the Quality Control and Safety Management of Industrial Products Act” were integrated. This study analyzed the integration process of the "Electrical Appliances and Consumer Products Safety Control Act” from the perspective of Kingdon's “Multiple Stream Framework(MSF)”. And we looked at what trends set the policy agenda in the process of policy change. The process of changing the law was divided into legislative stages, discussion, and revision stages. Through the literature survey, the flow of problems, politics, and policy alternatives was analyzed according to the time order. As a result of the analysis, large-scale events led the flow of the problem in the first legislative stage. Then, as related government ministries and agencies tried to strengthen regulations, the policy window quickly opened. The early bills were urgently revised because the legislative leadership expired their term of office. Therefore, the process of converging opinions of related stakeholders was excluded. A group of interested parties formed and strong opposition emerged, and they led the flow of new problems before the law came into effect. The new legislative forces led the political trend and prepared the revision through various process of gathering opinions such as public hearings and discussions. We could see the process of policy change, in which two policy windows are opened continuously. In the process of fluctuation, the flow of leading changes was different from each other. As a result of the analysis through the study, it is necessary to fully accept the opinions of stakeholders in order to set the policy agenda. In particular, technical regulations must be examined to enhance social acceptability.
