심리상담 법제화의 방향성

현재 우리나라에는 엄격한 검정과정 없이 발급되고 있는 수많은 민간 심리상담 자격증으로 인해 비윤리적·비전문적 심리서비스가 제공되는 경우가 있으며 이에 따라 내담자의피해가 급증하고 있는 실정이다. 이를 방지하기 위해 심리상담 관련 법제화 논의가 이루어지고 있다. 본고는 심리상담 학계에서 각기 상이한 형태와 내용을 담은 채로 제안된4개의 심리상담 관련 법률안(김영근, 2012; 김정진, 2016; 한국상담학회, 2021; 한국심리학회, 2020)을 쟁점 주제를 중심으로 비교 및 분석하였다. 이를 바탕으로 향후 우리나라의 심리상담 법령이 각 법령제안 주체들이 다르게 생각하고 있는 중점요소, 즉 자격의명칭, 자격의 형태, 자격조건 등에서 가지고 있는 이견을 좁혀나가며 법제화로 나아갈방향을 제시하고자 하였다.
Abstract
Damage to the clients is increasing rapidly because of provisions of unethical counseling based on numerous private counseling certificates issued without a strict qualification system in Korea. As a result, multiple attempts were made to enact a law related to psychological counseling services. This manuscript examined and analyzed the four drafts of proposed laws related to psychological counseling (J. Kim, 2016; Y. Kim, 2012; Korean Counseling Association, 2021; Korean Psychological Association, 2020), with a scope of recent issues and controversies. We discussed how to narrow those differences, including name, type, and requirements of the psychological counseling qualification or license, and move toward legislation of statutes of psychological counseling in Korea.
