대상판결은 소비자의 알권리 등을 주된 이유로 이 사건 표시로 인하여 보통의 주의력을 가진 소비자가 ‘GMO 성분이 포함된 유제품이 있을 수 있으나 이 사건 유제품에는 GMO 성분이 없다’고 오인･혼동할 가능성이 있다고 보기는 어려우므로 이 사건 표시는 소비자 를 기만한다고 보기 어렵다고 판단하였다. 법원이 법령의 문언적, 체계적 해석이 아닌, 유전자 표시의 확대가 필요하다는 가치판단을 전제로 오히려 사법의 한계를 벗어난 판단 을 한 것으로 볼 수 있다. 우리보다 훨씬 강력하게 GMO를 규제하는 EU에서도 대상판결 사안에서 문제되는 사안, 즉 GMO 사료를 공급한 동물에서 얻은 식품의 표시와 관련하여서는 아직 규제가 없다. 현재 EU의 강력한 GMO 규제에 대해 EU 내에서도 이른바 ‘기술중립성’ 관점에서 개정 필요성이 주장되고 있기도 하다. 나아가 관계규정의 입법론 관점에서 살펴보아도 GMO 규제에서 소비자의 알권리만이 유일한 고려사항이라고 단언하기는 어렵다.
Abstract
The target Budgment went beyond the possible interpretation of the legal text. It can be seen that the court made a Budgment beyond the limits of the Budicial system on the premise of the value Budgment that the expansion of genetic expression is necessary, rather than a literal and systematic interpretation of the statute. Even in the EU, which regulates GMOs more strongly than we do, there are still no regulations regarding the labeling of food obtained from animals fed GMO feed, which is the issue in the subBect Budgment case. Even if we look at it from the point of view of the legislative theory of related regulations, it is difficult to assert that the Budgment of the target Budgment is the direction we should aim for.
