Abstract
The principle of checks and balances attainable through a functional separation of powers brought forth the Prosecution's Office into the criminal justice system by separating a prosecution authority either from the judiciary―in France, Germany―or the police―in UK―regardless of the traditional classification of a jurisdiction into two different types, Common Law and Civil Law. However, ironically, the very same principle which gave birth to the Prosecution's Office has been collapsed by the Prosecution's Office in Korea. In its efforts to establish checks and balances against the Police after its independence from the japanese colonial Police State, Korea chose to provide additional authorities other than a prosecution authority to the Prosecution's Office instead of firmly securing the functional separation of powers. And the collapse of checks and balances in the criminal justice system of Korea enabled the Prosecution's Office to exercise its discretionary authorities in an excessive or insufficient manner which in turn deepened the mistrust of civilians in impartiality of criminal law enforcements. Although Korean society seems to recognize and share the concern over a failure of checks and balances against the Prosecution's Office, in which manner Korea needs to handle this concern? How could Korea recover the principle of a functional separation of powers and checks and balances which are lost in its criminal justice system? This paper aims to suggest proper directions of legal transplantation as a macro-answer to above questions through comparative criminal law studies based on horizontal-vertical researches analyzing legal history and trends from the past to the present instead of generic contrasts between artificial blocs.
